The Nagpur team of SIFF had conducted a press conf yesterday on Husbands suicide and that more than 7lakh men have been driven to suicide in the last 15 years . This has appeared in many Marathi dailies and many English dailies are expected to print it tomorrow . TV and local channels will also cover the Dharna scheduled on Nov 6th 2011.

7th May - Dharna in Bengaluru against Unjustified Maintenance/Alimony

We have organized dharna with theme being protest against "Intimate Terrorism and Family Terrorism" on 7th May, Sat from 10 am to 1:30 pm in front of Town Hall, near Corporation Circle in Bangalore.
All are welcome to join. Be there with family, friends, relatives, neighbours. I got to know one of my neighbors got screwed recently and his wife left him after doing usual tamasha and packing up things in his absence and went to her mother's house. Get in touch with all people you know and you will find at least 2 people who are going through something similar but not aware of SIF. Of course if you don't share with people about your life then people won't be aware even of YOUR case.
It is known experience in Bangalore that people who protest and do activism, keep winning their cases. They actually end up taking money from other side during settlement (on paper it looks as if they paid though but they have stuff from other side already).

Those who are too ashamed to protest, or want to hide, or want to stand far away from others even get their maintenance increased from 15K to 30K.

Indian Media supports 498a and Family Destruction

Recently the Law Commission was "once again" tasked with the job of reviewing 498a , and once again asked to provide recommendations if 498a needed to be changed . However the interesting thing is the stand that the media has taken on this whole issue . From the type of articles that have lately appeared in the press a few salient points are amply clear.

Media was thoroughly enjoying the gender war:- Innocent men going to jail , Mothers and sisters being imprisoned , Men coming out with a sense of vengeance . Some men creating ingenious methods like filing cases for giving dowry or thousands of dharnas and press conferences taking place on 498a all made for excellent masala news which the media loved to cover. There seems to be a sense of dissatisfaction in the media that these will cease of 498a becomes billable and people stop suffering. Let us further analyze this paragraph.

Media’s agenda of family breaking may fail:- Lets face it , media loves to see breaking families. Not only does breaking families leads to more spicy news like increasing crime , increase in gender violence both agsint men and women alike , most importantly breaking families brings immense financial gain to the media and its advertisers. How ? Here is how ….

Lets say a united family of husband , wife , grandparents and grandchildren share one house , one newspaper , one fridge , one TV and one microwave. The moment the wife is separated from the husband she will need a whole new set of duplicate articles for herself thereby essentially doubling the sales of all these articles. So the simple logic is that more number of times a family divides the more the consumerism increases overall . It is not just by chance that Americans consume the most inspite of having the most debt . The totally detroyed family system in US the prime contributor to the unhealthy consumerism. As a consequence we rarely ever see an article in Indian newspapers and the television preaching family harmony. In fact living with the family itself is projected oppression of women by Indian newspapers . The press seems to almost hail broken marriages and divided families and single parenthood for women is made to look as the cool thing . Women who choose to remain single are projected as role models for other women to follow and emulate. 498a is a major facilitator in family breaking since once this case is filed the chances of reconciliation are virtually reduced to zero. The media is hence dead against 498a being amended and Indian families remaining united.

498a articles in the press give away the resentment in the media :- The way the articles on 498a amendment are projected all have a very uncanny similarity.

1. The media knows that the majority of Indians would have this law changed , however the media still always manages to find and interview ONLY those people who they know have a vested interest in keeping this law alive. The faces against 498a amendment are far and few in between and are all familiar radical feminists of India and consist of mostly female lawyers and some feminist NGO’s naming whom in this blog will surely attract a defamation case against me. It common knowledge that 498a is the most major source of revenue for the lawyer fraternity. Over 30% of all bail cases arise out of illegal arrests and detentions under section 498a and if this is removed it will be a big blow to the income of the lawyers , a majority of whose make a living out of bail cases The media never is never able to find its way into the homes of the 100,000 women who have been illegally arrested under this section and interview then to decide if 498a needs to be amended or not.

2. Media always “questions” the fact if 498a needs to be changed. The articles in the press always have a headline that questions the fact if this law needs to be changed. If after countless court judgments , overwhelming misuse data , millions of extreme civil rights violations and thousands of husbands suicides later the media still questions the fact if 498a really need to the changed , it shows a inherent bias and exposes the fact that the media is clearly not happy that the law is changing.

3. Suicides of Husbands and arrests of women almost find ZERO coverage. The Media almost never fails to print the fear mongering and the lies that the few feminist lawyers and some radical feminist NGO’s plant about Indian women becoming more inflammable than gasoline after they married and spontaneously catching fire anytime they are in their husbands home, however it always conveniently ignores the fact that twice the number of husbands are driven to suicide as compared to wives , which is coming straight from the Ministry of Home affairs. The Husband data is conveniently brushed as economical reasons and the wives suicides are even more conveniently put under the dowry death header. If the husband can commit suicide due to economical reasons why can't the wife also commit suicide due to economical reason. Does the wife not have an equal responsibility as the husband to improve the economical status of the family failing which she can choose to kill herself . Why is the logic of dowry death applied to the wife and the logic of economics aplied to the husbands ? These are questions that the media never asks and one can never find such arguments questioning the absurdity of the data collection and the suicide statistics in the media. Is this not another point that points to the media's unhappiness that 498a is changing ?

4. The media knowingly plays into the hands of the feminists and projects spousal homicides as dowry deaths. This failed strategy of the feminists although has been dissected and thoroughly debunked many times since spousal homicide is already covered by laws like 304 and 304B which remain functional, the media continues to print it almost all its articles. The Media feels that justifying the need for 498a by quoting murder and spousal homicide statistics will somehow play in their benefit. There are 1250 spousal homicides of women in United States (according to FBI) and 1882 dowry deaths (spousal homicides+coerced suicides) of women in India every year. Spousal homicides without dowry angle are also classified as dowry deaths. So Indian spousal homicides are far less than the US if taken as a % of the population showing that women are much safer in India than the US.

5. The media is solely responsible for portraying the women as a victim theory leads which leads to female foeticide in urban India. People are afraid due to this false propaganda that girls are unsafe as they grow where as boys never face any crime. The truth is, a boy has 24 times more chance than a girl to face crime as he grows up. No one is telling this to young urban parents, who believe only girls are vulnerable and hence try not to have more than one girl in the family. However in 498a coverage the women as a victim theory is again reinforced.

Conclusion :- The media and women’s organizations have a lot of money and that money being used these days to buy print space to attempt to change public opinion fight a desperate battle to prevent amendment of a law that has caused irreparable hard to millions of men and women alike and has been responsible for breaking the social fabric of a nation. However the media forgets the fact that the generation that is now most likely faces these cases gets its news from the internet and not the press . Recently a journalist when shown the above facts of the media reacted violently and dismissed the facts calling us “bubblegum chewing youngsters” . The fact the bubble gum chewers can also chew on facts and data and mobilize such mass numbers to change a law that was once seemed the very essence of radical feminism and family destruction has gotten many people in a lot of industries into a lot of discomfort and the media is essentially one of them. 498a will change today or tomorrow and no one can stop that , because women will continue to misuse it in large numbers and resentment will only increase . In this battle of good vs evil or lies and deception vs truth the path that the media chooses is what remains to be seen. Will the media choose to needlessly alienate itself from the public and contribute to family destruction by projecting biased and one sided articles or remain on the side of the truth and project unbiased facts and figures and leave the public to draw its conclusions ? This is for the media to decide.

SC’s Vishakha Guidelines has been morphed into an open “Extortion” law

Before we even delve into the current draft of the bill we would like to point out that the Supreme Court of India in Vishakha Vs State of Rajasthan (AIR 1997 SC 3011 ) while framing guidelines clearly stated that “These guidelines will not prejudice any rights available under the Protection of Human Rights Act, 1993”.

However the sheer volume of the violation of the Human rights that the current draft of the law has is truly hard to believe. Credible research data and even common sense has been thrown to the wind and it seems the only motive of this law is to create a legal process of extracting money, in one way or the other.

Is Sexual Harassment of men also not a Violation of Fundamental rights?

This bill is another straight jacketed law that has been created right from the start with the sole agenda of extending protection only to women irrespective of the fact that this offence is completely gender neutral. Although many press and news articles and media have criticized this bill, the WCD ministry has bulldozed this act through the cabinet. This important Bill ignores the fundamental fact that Sexual Harassment unlike rape is not a crime of passion, but it is crime of power and in many instances the harasser can be of the same gender as the victim. We also fail to understand, why the present draft of the bill, completely misses out the important aspect, that Sexual Harassment of Men results in equal violation of the fundamental rights of equality under articles 14 and 15 of the Constitution of India and his right to life and to live with dignity under article 21 of the Constitution and right to practice any profession which includes a right to a safe environment free from sexual harassment. The bill essentially has a highly flawed straight jacket formula that only a woman can be a victim in any case and no man may be ever called a victim or complains of sexual harassment under this legislation just because of fact that he is a man.

Constitutional Violation

A subsection of an article in a constitution (Article 15(3)) cannot be used to overrule the main article in the constitution (Article 15). Article 15(3) of the constitution merely provides for special provisions for women and children. It does not permit the framing of special laws which will violate the essence of the Main Article 15. Had that been the case, the constitution of India will become self contradictory. Article 15(3) of the constitution although does allow the government to make special provisions for women, but the same article cannot be used to overlook the fact that women too can be perpetrators of the crime and absolve women from getting prosecuted for committing the same offence of sexual harassment. However this is what has been done in the Sexual Harassment at workplace bill.

Violation of the Universal Declaration of Human rights

The Universal Declaration of Human Rights states that “all are equal before the law, and are entitled without any discrimination to equal protection of the law”. Article 14 of the Indian Constitution declares that “The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India”. Unfortunately the present draft of the bill violates both the Universal Declaration of Human Rights and Article 14 of the Indian Constitution.

Exposing the Flaws (hidden agenda) and recommendations

1. The law is gender biased although the offence affects men equally as women

Credible research shows that in India more men than women suffer Sexual Harassment at work

Surveys recently conducted by the Economic times, and Synovate across 6 Indian cities exposed the fact that men face more sexual harassment than women and must also be given protection. As part of this very credible and extensive research 527 people queried in the survey across seven cities in the country - Bangalore, Chennai, Delhi, Hyderabad, Kolkata, Mumbai and Pune. Below are excerpts from the report to expose how often Males are sexually harassed. The report is attached as Annexure 1.

a) Bangalore: - Half of who agreed that they have been sexually harassed at their workplace said they have been harassed by their female colleagues. Only 32% said that they were harassed by Male colleagues.

b) Hyderabad: - 29% of said they have been sexually harassed by their female bosses while 48% accused their male bosses.

c) Delhi: - Numbers are even, with 43% pointing a finger at their female colleagues and an equal number accusing their male colleagues of sexual harassment.

d) 38% of the respondents agreed that in today’s workplaces, even men are as vulnerable to sexual harassment as women. In Hyderabad and Mumbai, 55% of the respondents agreed to this point.

e) Many of the corporate and PSUs, ET spoke to, agree to this new trend and point out that many male employees do not come out in the open and file complaints because they feel they will not be believed, considering India’s social beliefs. They usually seek a transfer to get out of the situation or find a new job.

The Sexual Harassment at workplace policies prevalent in most of the nations today are gender neutral however India takes a drastically different approach. According to a report on Sexual harassment at workplace by United Nations Economic Commission of Europe - Austria, Belgium, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Ireland, Italy, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, The Slovak Republic, Slovenia, Spain, Sweden, United Kingdom have policies for Sexual Harassment, that are gender neutral. The US and most countries in ASEAN region also have Gender Neutral laws. Even neighboring Pakistan has Gender Neutral Sexual Harassment policies. The gender neutral definition of sexual harassment from US equal employment opportunities commission (EEOC) is attached as Annexure 2.

Recommendation :- Make the law gender Neutral since men too can become equal victims of this crime and empowering women cannot be achieved with disempowering and abusing men and that seems to be the motive of this law.

2. Constitution of Committees and Compensation paid to Committees

Section 7(1) (a) states :- “A Chairperson to be nominated from amongst the eminent women in the field of social work and committed to the cause of women”

Section 7(2) and Section 7(4) of the draft bill speaks about the tenure and remuneration for the Committee members.

Section 7(1) (c) states: - “at least one shall be a woman, to be nominated from amongst such non-governmental organisations or associations committed to the cause of women, which may be prescribed”

Section 7(1) (d), states: - “Provided that at least one-half of the total Members so nominated shall be women”

The Supreme Court’s Vishakha Guidelines on Sexual Harassment on which this law is supposed to be have been framed and structured, nowhere mentions that a prequalification to be a member of the Sexual Harassment Committee is that the person shall be “committed to the cause of women”.

However the law drafters have given a very feministic twist to this whole idea of involvement of ideological social workers from external NGO’s in Sexual harassment committees. Instead of appointing people who have demonstrated a track record of high integrity and sound judicial approach the bill rather intends to appoint people who shall be “committed to the cause of women”. The use the phrase ‘committed to the cause of women’ in fact finds mention in several places in the draft bill and its connotation only suggests that this will lead to not only inherent bias and prejudice against men in general but also will result in frequent overlooking the merits of the case in order to provide some sort of reward to the woman.

Since a healthy presence of sexual harassment cases within a department would only justify the need for such paid committees to exist, these NGOs who will be driven to justify their existence, grab plum remuneration and a piece of the settlement arising from cases will most certainly encourage women who are not necessarily harassed, but have other grievances with the organization, to file false sexual harassment complaints.

Recommendation :-

1. People in the committee must be “Committed to the Cause of Justice” and not be paid any compensation.

2. Interested parties must provide this service free to the society and there must be no burden to make payments to these people to pass decisions sexual harassment cases. Retired judges and retired senior female and male employees of the same organization can be requested to sit part time on these committees after retirement.

3. Compensation if a must be kept limited to Rs 500 per case and must be paid on a case by case basis so that there be among employees to sit on a committee to get lucrative compensation.

4. Any stipulation with respect to number of women in the Committee is unnecessary and makes a prejudiced assumption that only women are capable of arbitrating complaints.

3. Provide clarification on Power of the Committees

Clause 11(2) states: - “..the Internal Committee or the Local Committee, as the case may be, shall have the same powers as are vested in a civil court under the Code of Civil Procedure, 1908 when trying a suit in respect of the following matters, namely:—

(a) summoning and enforcing the attendance of any person and examining him on oath;

(b) requiring the discovery and production of documents; and

(c) any other matter which may be prescribed.”

Recommendation :-

A group of women from NGO’s with no legal mandate and calling themselves “committed to the cause of women” cannot be vested with the same powers as are vested in a civil court under the Code of Civil Procedure. The complainant must also be mandated to present their evidence under oath just like anyone else, so that if proved lying she can be tried in a civil court just like an ordinary perjury case.

Also the authorities of the committee must be clearly defined and section “any other matter which may be prescribed.” must be summarily deleted since this can lead of a wide ambit of power in the hands of the committee which might have no bearing to sexual harassment. This clause might lead to committee assuming a position of judges within the organization and deliberating on all issues whatsoever.

4. Bargaining “Punishment” with “Settlement” (Settlement in India means BIG MONEY!!)

Section 10 (1) states – "The Internal Committee or, as the case may be, the Local Committee, may, before initiating inquiry under section 11 and at the request of the aggrieved woman take steps to settle the matter between her and the respondent through conciliation".

The option of Settlement is once again a clear violation of Vishaka guidelines. By legally providing a mechanism to bargain punishment with settlement, the act becomes a tool for “legal extortion”. This will also initiate a rate race among NGO’s to have themselves represented in various companies in order to grab a pie of settlement. Such trends will undermine the real essence of the act and a parallel extortion industry will start spawning. From our vast experience in dealing with 498a and DV cases, A “Settlement” in the Indian legal system points towards only one thing. Payment of Money! The whole idea of settlement is incorporated with the sole intention that government very well knows that most cases will be false and will not stand the rigors of a full fledged investigation.

Recommendation :- Provision of any sort of monetary “settlement” is the biggest attraction for misuse of any law and must be summarily removed. The accused must be either punished or the complaint must be deemed as false and action taken against the complainant.

5. Make the organization accountable for compensation and not the individual

Clause 13(3)(i) states :- “ …to take action for sexual harassment as a misconduct in accordance with the provisions of the service rules applicable to the respondent or where no such service rules have been made, in such manner as may be prescribed;

Section 13(3)(ii), states – “to deduct, notwithstanding anything in the service rules applicable to the respondent, from the salary or wages of the respondent such sum of compensation to be paid to the aggrieved woman or to legal heirs, as it may determine, in accordance with the provisions of section 15:”

The option of the burdening the respondent for paying the compensation coupled with little evidence and scope for “monetary settlement” will make this law a weapon of choice for disgruntled women seeking vengeance on men. In the western countries even where there is Gender Neutral Sexual harassment laws it is the organization that actually compensates the complainant and therefore the investigation on the complaint is done with much more scrutiny since it is organizations income and assets are at risk. However with this requirement removed there will a huge number of false victims under this law who will be forced to pay from their own pocket

Recommendation: - If the allegations are proved, it must be the responsibility of the organization to make the required compensation to the complainant. The organization would then be free to make a decision on the action it wants to take against the respondent based on service rules.

6. Punishment for misuse is not “Mandatory”, but “Discretionary”

Section 14(1) States: - “Provided further that the malicious intent or falsehood on part of the complainant shall be established after an inquiry in accordance with the procedure prescribed, before any action is recommended”

Section 14(1), also states : “…may recommend to the employer or the District Officer, as the case may be, to take action against the woman or the person who has made the complaint”.

We would also like to humbly remind the Hon’ble Committee Members that on 7th August, 2009, when some Feminist NGO’s lobbied for deletion of the Misuse Clause from the draft bill all the Women Member of Parliament unanimously agreed that a Misuse Clause is very much needed to prevent misuse of this loosely worded bill. Unfortunately, after the above consensus was reached, with the Women MPs, the very misuse clause has been drastically changed to, make the bill, ironically, even more prone to misuse.

By making punishment for misuse discretionary (…May Recommend) the bill opens the scope for negotiation between the parties to either avoid punishment or settle the matter. This provision will also lead to motivation for filing more and more false cases to settle personal scores - A trend commonly observed in the use of section 498a and Domestic Violence Act. If the statistics from the Indian Government related to section 498a and Domestic Violence legislation is anything to go by, it is clear that Indian Gender laws are phenomenally misused in India to achieve ulterior motives. However In section 12(1), the Sexual Harassment at Workplace Bill states that if a complaint is found to be false, the committee “may recommend to the employer or the District Officer to take action against the woman or the person who has made the complaint”. Or in other words, the punishment for making a false Sexual Harassment in not mandatory but discretionary and would depend on the recommendation of members of such NGO’s whose sole selection to the committee was dependent on their level of being “committed to the cause of women”.

Recommendation: - A falsely accused person must be allowed to seek justice in a normal court of law. Punishment for misuse must me made mandatory and not discretionary. Clear rules and procedures must be defines for false cases. No settlements must be allowed on this area.

7. This law is a MONEY MAKING BONANZA to complainants, women lawyers and Women’s NGOs at the tax payer’s expense.

Clause 19(h) states that the Employer shall “initiate action, under the Indian Penal Code or any other law for the time being in force, against the perpetrator after the conclusion of the inquiry, or without waiting for the inquiry, where the perpetrator is not an employee in the workplace at which the incident of sexual harassment took place.

At the onset it clearly appears that the law appears to have to do little to eradicate sexual harassment at work and has more to do with providing a steady source of income to women complainants, lawyers and women’s organizations at the expense of the tax payer money. It is laughable that in clause 19(h) highlighted above, this bill states that when the person is not an employee then laws under IPC can be used to initiate action but when the person is an employee then sexual harassment laws can be used. Also how can the employer be authorized to initiate action against a person before establishing guilt? Guilt can only be established after the enquiry is complete.

The reasons why IPC laws have not been considered are as below.

The new law is trying to fulfill the following objectives

1) IPC laws can punish the victim but cannot pay money to the complainant which this law is trying to remove. Money is the essence of this law.

2) IPC laws do not have provision for channeling tax payer money to women’s NGO’s and lawyers.

3) In the present bill there is no punishment for the perpetrator, whereas the victim gets monetary compensation, for alleged Sexual Harassment, with an elaborate totally unnecessary requirement of paid committee members from various women’s NGOs, whose sole qualification would be “committed to the cause of women”, Not only will these committee members be a drain on tax payer money but this will create parallel industry among them to get appointed to committees to protect their revenue stream.

4) IPC laws are evidence driven while this law is totally silent of the requirement of solid evidence to first prove guilt of the perpetrator. Also very special measures like a ban on RTI on enquiry proceedings would ensure that the murky trading of complaint enquiry and sub sequent settlements are done under the secrecy and this would open the bill to rampant misuse.

5) IPC laws are fought by Govt appointed Public prosecutors, however in this case the complainant and the defendant would have to appoint lawyers of their own and that would lead to excellent income generation of lawyers.

Recommendation

The existing laws in the IPC are extremely robust and provide relief based on evidence and not on paid women’s organizations deciding on the future course. This law is essentially a duplication of an existing law created with the premise of opening a channel to tax payer money to NGOs and lawyers.

8. Safeguarding misusers and cases of misuse by gagging the RTI act

Section 16 prohibits the publication or making known, the contents of complaint and enquiry proceedings when the case is false. However there is no restriction on disclosing information on true cases.

The above shows how much thought has gone into protecting misusers by the drafting committee. In a democratic nation, transparency is the key to success of governance. To ensure the same the government of India benevolently gifted the RTI act to the citizens of India, but the same government is including provisions in this bill to prevent the use of RTI act to unearth false cases filed under the act. This is nothing but double standards on part of the government. Alarmed at the burgeoning reality of the misuse of section 498a and DV act this draft for the Sexual Harassment at Workplace Bill has a unique approach to keeping the false cases under wraps. Special provisions have been made in this bill so the RTI Act cannot be used to unearth cases of false allegations and misuse of this legislation. Only cases which are genuine shall be opened to the media and information seekers. This is another very ingenious attempt to strangle the news of misuse itself since now the pubic will be exposed only to news of successful cases and stories of false cases will be legally prevented from leaking. This will also give complete deniability since now the Indian government will be able to say that since there is no news of misuse at all in this law and consequently it is a very successful piece of legislation.

Recommendation
When, either the complainant or the respondent wishes to approach any court of law for justice, they should have a right to the details and proceedings of the enquiry.

They break into a discussion on alimony and come up with reasons on why it is the right of a wife to enslave the husband and make him work for paying her alimony since she afterall provided the service of getting married to him. After all jitsnt it just fair that just because one human being has different set of sexual organs than another, it gives that human being a right to enslave the other human and make him work as a matter of right . WOW !! Are we still in era of plantation slaves where the law mandated that the skin color of a person would make him a slave his entire life and earn for his master .

This is what happened in the so called "All India Alimony conference" that discussed on how to encourage all self respecting women who earn their own bread to become parasites oin their husbands .The conference concluded that women as a class must be fed by men after marriage no matter what because according to the "experts" women seem to have provided some sort of service by marrying a man for which they have to be compensated for monetarily or through assets . As usual no mention was made of issues in women not inheriting property from their own parents or helping women stand on their own feet . The speakers thought that the woman's first right was in her husband's property even if she was married for 2 months and not in the property rights oif her own father even if she spent 25 years in that house.

Some of the phrases uttered by the participating "stars" of Indian feminist movement .

“We need to, at first, look for alternatives to the word maintenance.”

Sure we have been asking for that for all this time. Shall we call it “retirement benefits” or “extortion booty” since when a woman retires from a marriage of 2 months she is entitled to alimony for 20 years , right ? Why does she ever need to work when her marriage has found her a very own slave who will continue to slave for eternity and provide for her . Is this not marriage all about for women ? Why will woman ever need to stand on her own feet and fend for herself , since her husband is supposed to slog it out and fend for her as she enjoys in the marital lifestyle which she broke out of .

“The first step is to change this perception and start looking at it as a right”

Sure, right to alimony, right to harassing the husband using DV and 498a ,Right to not allowing the father to meet the child using existing child custody laws . All these are fundamental rights guaranteed by the Indian constitution. All wives will have a right to sit idle at home like parasites and force the legal system to make their husbands work for them. All wives will have a right to profit from the marriage irrespective of their contribution in the marriage. No right will be given to the husbands to seeking alimony from the wife. Needless to say the husband never had and will have any rights whatsoever since he is a male.

"The stigma associated with single women, the paltry amount in alimony, expenses incurred during trials, "class and gender bias" among lawyers are some of the problems that were raised during the course of the seminar."

Government Subsidizing a woman’s vengeance is the idea these women are talking about . Cases like 498a are already fought "for the wives by the government " even though 98% cases are false . The govt is sent on a wild goose chase for decades on false cases and crores of rupees money are spent subsidizing millions of false cases .Is the husband not incurring an expense in the trial ? Who is supposed to pay for his expenses .? Opps sorry ..go back to point earlier point …”A husband has no rights since he is a male “. Why do I keep coming back to the Husband’s right point again and again ?

“Women often feel that they are doubly harassed, first by their husband and marital families and then by the police and lawyers they approach for help,”

Ok so now the husband must also compensate the women for harassment from police and lawyers . Laws like 498a and DV not withstanding which need zero evidence and can be filed even if a woman is bitten by mosquito residing in the husband’s jurisdiction .

Are the husband’s not harassed even more by the same set of police , judiciary and lawyers ? What about the women in the husband's family ? Oh !!…not once again … A husband has no rights since he is a male !!“….

"These are the least of their problems. In addition, they have to carry the stigma of being a single woman, go through the cumbersome judicial process, try to meet the expenses for each hearing and the end of all this make-do with the meagre alimony they get which can be as low as Rs 500 per month,"

Ok , how do we compensate women for stigma ? More MONEY !!! Will the stigma of a person be called a thief be alleviated if he is paid money from the someone , yes it will be if the thief is a woman woman? The women are complaining that women must be always be entitled to their fruits of labor after negotiating the labyrinthine judicial process ? Instead of spending time in courts what is stopping women from using their education or woman to to elk out a decent living ? After all why are we spending RS 11,000 crore of tax payer money (82% being funded by men ) to educate India women if a parasite is what we have in mind who feeds on the husband .

"A primary recommendation that emerged during the discussion is that all separated, divorced Indian women must be entitled to at least half the share of assets in marital home or assets acquired by couple during the period that they were together"

Ok Now we are talking .. If that is the case , Can I stay in the wife’s house for a few days after marriage and then take half her paternal property away ? Can I also get a share of half the dowry she claims to have given . Can I also take away half her income ?

For a million times NO !!!...........for a “ A husband has no rights since he is a male !!“ How many times do I tell you this ??

Conclusion

The feminists have essentially lost even more credibility in eyes of the law and the people by these statements. Women empowerment can never happen by breeding an army of parasite wives. A marriage is not a service that the woman is providing the man and hence she cannot be legally entitled to get paid for the service. A marriage is a partnership and if why one partner should be forced to pay another partner if this partnership should break. The whole idea of Alimony is to provide temporary support to a “person”( husband/wife) who has contributed to the marriage and needs that support. The support is for the person to able to stand on his/her own feet and resume normal life . Yes , the support should be directly proportional to the person’s contribution and requirements( including children ) and cannot be made a right no matter what . Forcefully providing support to a parasitic wife included to enjoy at the husband’s expenses while voluntarily incapacitating herself at home would lead to sending a totally wrong message to the young girls whose sole idea then would be to make a “good catch” in the form of a husband and then milk him for alimony . Is this the sort of future generation of Indian women we are envisioning ?

What is Rape ?

The word rape itself originates from the Latin verb rapere: to seize or take by force. According to the feminists Rape is about power, not sex. A rapist uses actual force or violence — or the threat of it — to take control over another human being. Rape is categorized as a crime against humanity.

How can a rapist exercise power on a victim?

A rapist can exercise power on a victim either physically or legally. When it comes to physical rapes since men are physically more powerful than women and this results in a significantly larger percentage of physical rape victims being women .

There are also a lot of instances when a wife wants to illegally exercise her power on her husband and use actual force or the threat of it to take control of her husband. In these instances the wife legally rapes the husband using government backed laws and misusing the state machinery.

What is a legal rape ?

A legal rape is a situation when a person used the legal system to unleash trauma and violence on the victim in order to exercise power on the victim and to control the victim.

How Indian husband are legally raped?

In order to exercise her control and power over her husband ore in some instances punish him for not towing her line Indian wives frequently resort to using her legal power to unleash trauma and suffering on the husband many times over his entire family . Primary among the tools of legal rape are section 498a , DV act of 2005 , Maintenance and Child custody laws.

The symptoms leading to the legal rape have an uncanny similarity to the physical rape of women.

a) The legal rapist is always close acquaintance of the victim in the from of wife , daughter in law or sister-in-law.

b) The victim refuses to abide by the whims of the rapist.

c) The rapist develops deep rooted hatred for the victim and has a desire to control the life of the victim and exercise power over the victim.

d) The rapist uses her legal force to rape the victim.

e) Many times the wife legally rapes the husband impulsively as opportunity presently itself and might later regret the act.

f) Very often the legal rapists say that the trigger for the legal rape was when a husband made them angry, usually by rebuffing a wife’s whims and fancies or toeing her line.

The effects of Legal Rape ?

Just like the symptoms the aftermath if a legal rape is also similar to a physical rape.

Victims of legal rape can be severely traumatized by the assault and may have difficulty functioning as well as they had been used to prior to the assault, with disruption of concentration, sleeping patterns and eating habits, for example. They may feel jumpy or be on edge. After being legally raped, it is common for the victim to experience acute stress disorder, including symptoms similar to those of posttraumatic stress disorder, such as intense, sometimes unpredictable, emotions, and they may find it hard to deal with their memories of the event. In the months immediately following the legal rape , these problems may be severe and very upsetting and may prevent the victim from revealing their ordeal to friends or family, or seeking police or medical assistance. Additional symptoms of Acute Stress Disorder include:

* Depersonalization or dissociation (feeling numb and detached, like being in a daze or a dream, or feeling that the world is strange and unreal)

* Difficulty remembering important parts of the assault

* reliving the assault through repeated thoughts, memories, or nightmares

* Avoidance of things, places, thoughts, and/or feelings that remind the victim of the assault

* Anxiety or increased alertness (difficulty sleeping, concentrating, etc.)

* Avoidance of social life

For one-third to one-half of the victims, these symptoms continue beyond the first few months and meet the conditions for the diagnosis of posttraumatic stress disorder

The facts of legal rape in India

The incidence of legal rapes of husbands is thousands of percentages higher than that the physical rapes of women. The legal rape has become a profitable industry for the Lawyers and the Legal rapist wives.

The legal rape system is backed by the government even though there is little difference between raping a woman by physical force and raping man using legal force .

Physical rape affects one woman , while legal rape affects the family of the man including men , women and children

In Legal rape the victim of the rape is asked to compensate the female rapist. No legal rapist has ever been [punished in India for committing such a heinous crime .

The Indian government has no welfare schemes to rehabilitate the victims of legal rape. Instead finds are allocated to encourage females to legally rape husbands and protect them from prosecution for the legal rape.

Trauma of a legal rape lasts for a entire lifetime and is much more severe than a physical rape. Many times husband are forced take their own lives after being legally raped by the law.

Indian Media acknowledges the shortfalls of the Sexual Harrasment Bill

The Indian media has overwhelmingly acknowledged the fact that the Indian version of the Sexual Harassment at workplace Bill is flawed and needed to be amended immediately .

The Government is now on the back foot and is using the tried and tested tactic of stating that let the bill come into place and then we will look into it . However this tactic was also adopted during the creation of the heavily misused Domestic Voilence Act 2005 . Once the act came into being a parallel industry starts around it and then it is next to impossible to change the law . The Indian people have demanded that this time the draft of the Sexual harassment act be discarded that a new draft be made considering making it gender neutral .

The Demand for Gender Neutrality is nothing new . In fact way back in 2007 over 400 women's organizations under WomensPowerConnect (WPC) themselves asked for the bill to be made gender neutral as the below news article elaborates.

Sexual harassment at workplace Bill will spawn a new extortion industry

This press conference is being conducted by a coalition of NGO’s under the umbrella of the Save Indian Family Foundation (SIFF) . All NGO’s are non-funded , non-profit NGOs fighting for , Gender Equality , Judicial accountability and balanced laws by creating awareness towards the creation of balanced gender neutral laws so that they are both constitutional and provide justice to all individuals irrespective of gender and sexual orientation. This press conference has been scheduled to highlight the undemocratic law making process of India and expose the fascist nature of the same. Sexual Harassment at Workplace Bill (SHWB) is in its current form is unacceptable for a sane and just society because

1. It out rightly violates the essence of article 15 of Indian constitution which prohibits discrimination against any citizen on the grounds of religion and sex

2. SHWB initiates contempt of court by violating the guidelines of the land mark SC judgment of Vishakha which was passed in 1997

3.There is a clear intention to influence decision making by mandating appointment of people, “committed to the cause of women” .Such compulsions categorically rule out Sexual harassment of Men without any basis.

4. It legally mandates the suppression of false cases with an intention to give a façade of proper use by restricting the use of RTI act on the law.

5. It legally mandates that punishment for misuse be made “discretionary” and not “mandatory “so that misusers are safeguarded

6. Allows the bargaining of “punishment” for “settlement” with a clear intention to extort money from the trapped individuals

7.The Drafting committee arrogantly ignored overwhelming public opinions asking for the bill to made gender neutral and thereby exposed the fascist law making attitude with which gender laws are drafted in India.

Controversial realities of the Sexual harassment at workplace Bill

1. Constitutional Violation

A subsection of an article in a constitution (Article 15(3)) cannot be used to overrule the main article in the constitution (Article 15). Article 15(3) of the constitution merely provides for special provisions for women and children, it does not permit the framing of special laws which will violate essence of Main Article 15. Had that been the case the constitution of India will become self contradictory. Article 15(3) of the constitution although does allow the government to make special provisions for women, but the same article cannot be used to overlook the fact that women too can be perpetrators of the crime and absolve women from getting prosecuted for committing the same offence.

2. Clear Violation of Vishakha Guidelines

The SHWB is based on Vishakha guidelines of the Honorable Supreme Court. The guidelines mentioned in the judgement nowhere mentions that a prequalification to be a member of the Sexual harassment Committee is that the person “shall be committed to the cause of women”. However, by involving NGO’s “committed to the cause of women” the government of India has blatantly violated the honourable Supreme Court guidelines. Such deliberate language will only intensify the existing bias against males which is inherent in the 15 odd anti male laws currently existing.

3.Economically disastrous recommendation

By making it mandatory to pay remuneration to the committee members irrespective of instances of sexual harassment reported creates unnecessary financial burden on companies. In times of global recession such financial burden will only lead to further economic losses to Indian companies. It will lead to an increase poverty , crime and corruption.

4. Justice delivery mechanism will become a fish market

NGO’s and their appointees will have to be paid after getting appointed to the committee even if there are no instances or cases of Sexual Harassment at all. The involvement of the payment model will lead to NGO’s selling justice for a price and NGO’s competing with each other get appointed into committees to get financial payouts.

5. Punishment for misuse is not “Mandatory”, but “Discretionary”

By making punishment for misuse discretionary the bill opens the scope for negotiation between the parties to either avoid punishment or settle the matter. This provision will also lead to motivation for filing more and more false cases to settle personal scores - A trend very commonly observed in the misuse of section 498a and Domestic Violence Act of 2005.

6. News of False cases/Misuse will be legally suppressed

In a democratic nation transparency is the key to success of governance. To ensure the same the government of India has benevolently gifted the RTI act to the citizens of India, but the same government is including provisions in this bill to prevent the use of RTI act to unearth false cases filed under the act. This is nothing but double standards on part of the government.

4. Bargaining “Punishment” with “settlement “ of cases

By legally providing a mechanism to bargain punishment with settlement the act itself becomes a tool for “legal extortion”. This will also initiate a rate race among NGO’s to have themselvesrepresented in various companies in order to grab a pie of settlement .Such trends will undermine the real essence of the act and a parallel extortion industry will start spawning .

5. Unconstitutional and undemocratic process followed during the drafting of the bill

RTI responses has exposed that during the drafting of the Sexual Harassment at workplace bill the WCD ministry had received numerous representations from concerned Indian citizens to make the SHWB law gender neutral but did not heed to any one of them. If public opinion of making the law gender neutral is to be finally totally trampled with, then why carry the farce of calling suggestions, in the name of democratic law making, from the citizenry and then discard it ?

The ministry chose to trample all the representations by the below outrageously sexist statements degrading the modesty of men as compared to women. The WCD ministry stated the below.

“The overwhelming nature of sexual harassment is sexual harassment of women on account of their female sex. Harassment of men cannot be put on the same footing character wise or incidence wise. Protection of men is also not the mandate of Ministry of WCD”.

1) “The overwhelming nature of sexual harassment is sexual harassment of women on account of their female sex”

This is a totally unscientific “assumption” that the WCD makes. The WCD Ministry or the Supreme Court does not have any data to back this argument because the government of India has not spent either a rupee or conducted a single credible study on men’s issues in this area. On the contrary, credible research all over the world concludes that men too are increasingly falling victims to sexual assault crimes every year. The US, the UK , whole of European Union and most of the countries have gender neutral sexual harassment laws. Drafting laws based on hallucinated assumptions can lead to disastrous social consequences and cannot be allowed.

2) “Harassment of men cannot be put on the same footing character wise or incidence wise”

The WCD ministry must be called upon to explain the meaning of this sentence and on what basis they concluded that the harassment of men is on a lesser footing than women. Does the WCD consider men any less of human beings than women? Is the stigma and suffering of a man any less than women if sexually harassed at workplace? The comments of WCD are openly violating Article 15 of the Constitution, which prohibits against any discrimination on grounds of sex and cannot be held with any credibility.

3) “Protection of men is also not the mandate of Ministry of WCD”

The WCD ministry is absolutely right in its above observation. Having said that as they officially accept they do not represent more than 50% of the population and hence they have no moral or social right whatsoever to draft a law affecting the whole population of India. It is as good as saying that the honorable the Prime minister will allow the drafting of the law concerning Hindus and Muslims by a ministry that openly claims that it does not have the mandate to protect the Muslims. Will it not lead to religious war? Then how such stances of the WCD cannot incite gender war?

Demands

The coalition of multinational NGO’s supporting this press conference strongly opposes the Bill in the present form and demands that the current draft made by the WCD be discarded and a fresh draft is created taking into consideration the following points.

a) The Sexual Harassment at Workplace Bill must be reviewed and amended immediately to make it Gender Neutral.

b) Heavy punishment must be given those who are responsible for ignoring the overwhelming public response and openly discriminating men and violating article 15 of the Constitution of India which prohibits discrimination against any citizen on grounds of religion and sex as well as wrongly interpreting Article 15(3) of the Constitution, by EXEMPTING women from punishment for committing the SAME crime, as Men, of Sexual Harassment.

c) The mandatory inclusion of National Human Rights Commission (NHRC) as a watchdog group in every gender law making committee so that men are not deliberately discriminated against and Article 15 of the Constitution is not violated again and Article 15 (3) is not wrongly interpreted and that the people’s opinion are not brutally trampled as has been done in the Sexual Harassment at Workplace Bill.

d) The mandatory inclusion of corporate bodies like FICCI and CII and a corporate committee comprising an equal number of male and female members from the industry so that interests of both genders are kept in mind while drafting laws to truly achieve a equal opportunity workplace.

e) Involving external NGO’s based on legal knowledge and their background of delivering justice on merits and not merely being women’s rights champions.

f) Allowing the reporting of all cases true or false in the media so that the magnitude of use or misuse can be measured.

g) Provision of any sort of settlement must be removed. The accused must be either punished or the complaint must be deemed as false and action taken against the complainant. The spawning of the extortion industry must be stopped at the root.

h) Since the laws that are drafted by the Women and Child development will only lead to gender imbalances and advancing social destruction, the Women and Child Development ministry must be removed from the law making process with immediate effect.

All the western countries have Gender Neutral Sexual Harassment at workplace laws

1) All employers are committed to maintaining a workplace where EACH employee's privacy and personal dignity are respected and protected from offensive / threatening behavior, irrespective of gender.

2) It is incorrect to presume that only women are prone to sexual harassment. With growing urbanisation, mindless westernization, and an increasing number of employee workforce positioned globally the issue of sexual harassment at workplace has acquired new dimensions. Men are as prone to being sexually harassed as women are.

3) The Sexual Harassment at workplace policies prevalent in most of the nations today take cognizance of the facts mentioned above and are gender neutral. According to a report on Sexual harassment at workplace by United Nations Economic Commission of Europe - Austria, Belgium, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Ireland, Italy, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, The Slovak Republic, Slovenia, Spain, Sweden and the United Kingdom have policies for Sexual Harassment that are gender neutral.

6) There are numerous studies which conclude that Men at workplace are being increasingly harassed and victimized:

(a) In United Kingdom, a survey conducted by the UK Department of Trade and Industry reports that men constitute 41% of sexual harassment victims.

Indian People want Gender Neutral Sexual harassment at workplace Bill

The Government of India now seems to be only party that does not want the bill to be gender neutral ! It may be recalled that the Women and Child Development Ministry which was responsible for drafting the Sexual harassment at workplace bill(SHWB) rejected an overwhelming number of representations from the Indian citizenry seeking to make the bill gender neutral . To reject demands to make the bill gender neutral the WCD Ministry had famously used the below sexist comments which were later uncovered using RTI's .

Indian Democratic law making process

In a democratic law making process the government creates laws in accordance with the public opinion expressed by the people. In fact, democratic law making derives its authority from the people. Public opinion is considered to be the most essential element for successful working of democratic communication in the system. Public opinion is the expression of the views of citizens. No government can afford to ignore it. In a democratic law making process that is required to be followed. In India, the government must always be cognizant of public opinion and take note of the same while formulating laws for the common good. Governmental policies and laws are invariably affected by the people’s opinion on various issues. Public opinion is the best barometer that helps any government to enact laws given the current situation. Public opinion in law making process also helps in

a) Acting as a guide to the law drafting process.

b) Watchdog that prevents the government from creating badly drafted one sided laws and violations of civil liberties

c) Protects the rights and liberties of all citizens irrespective of gender and age

d) Protects the citizens from laws pushed for by people with vested interest

Public opinion on current and proposed gender laws are frequently ignored

Unfortunately in India although the law making process include a step where the government is required to invite public opinion on a law draft, seldom is this opinion considered. The language of the law is heavily influenced by the requirements of pressure groups with vested interest. Laws are seldom neither drafted nor amended based on public opinion although the process is ironically democratic law making.

Public opinion on current gender laws

India is today witnessing phenomenal abuse in the areas of gender laws like Section 498A of the IPC and The Protection of Women from Domestic Violence Act along with the various maintenance laws like Section 125 of CrPC, Section 18 of The Hindu Adoptions and Maintenance Act, Section 24 of the Hindu Marriage Act and the rape laws to name a few. Not a single day goes by where in there is not an article in the press, or a discussion on TV or an internet editorial wherein the need to amend these laws is stressed upon. There has been millions of gallons of ink spilled on explaining how these laws are destroying the family system, how they are unconstitutional, how they are harassing the innocent and unable to protect the real victims, how they are burdening the Judicial docket with malicious litigations and finally how they need to be made gender neutral. There have also been hundreds of seminars, Multitude of Supreme Court and lower court judgments and reams of data have been gathered in the process to show the government that the public opinion clearly and overwhelmingly supports the amendment of these laws.

Why have the laws still not changed

So why has the laws not changed even though the majority of the Indians want the laws to change? The Indian law making process shows an outwardly appearance of being dependent on public opinion, but on the inside it is actually controlled with an iron hand by pressure groups with vested interests. Gathering public opinion on creating and amending laws is but a farce and hogwash and the government seems to abide by it just because it has a mandate of simply “gathering” public opinion. Feminist Pressure groups are today successfully holding to ransom the entire public opinion of the people of India and also block the Home ministry’s keenness to amend these laws. Even the Indian judiciary watches helplessly as their comments and suggestions are ignored for decades owing to the control influenced on the government by these people with vested interests. On the issue of Gender laws like Section 498A and the Domestic Violence Act the opinions of the Supreme Court and the Law commission of India which are the two apex law formulating bodies of India hold little value or respect in the eyes of the government which is instead keen on bending over backwards to please these pressure groups . Below are 2 very recent examples where few people with vested interest have successfully trampled overwhelming public opinion and stopped laws from changing.

a) The Home ministry in a communication admitted that they are unable to amend section 498A due to protests from some people with vested interest

b) Home Ministry did not notify section 41A of the CrPC amendments owing to the protests from some lawyers clearly working to safeguard their own bail revenues.

The government has for decades ignored the good recommendations and proposals from the Supreme Court or the Law Commission owing to the pressure exerted on it by these people working for their vested interests. If such people ultimately determine India legal policy then why do we even conduct the democratic drama of asking for public opinion on law making and amending? Why do we even call the law making process democratic?

The Sexual Harassment Workplace Bill (SHWB) is a textbook example of how public opinion was trampled by some people with vested interest

The SHWB is recent bill where overwhelming public opinion was ignored by the WCD Ministry.

The Sexual Harassment Bill was the outcome of an Apex court Judgment in 1997 which was in response to a Writ Petition WP No 666-70 of 1992. It is pertinent to note that laws and opinions of courts change very quickly with time and it is almost 20 years since the WP was originally filed. The condition, motivation and numbers of women in the workforce have swelled massively since 1992 and women now get an equal opportunity in almost all areas of employment either through merit or reservation.

Public Opinion about Sexual Harassment in 2007

The Sexual harassment act if drafted in the year 1992 might have received major support from the Indian Public to make it a women’s only law and not offer any protection to men from sexual harassment. However public opinion changes with time and our society has undergone massive changes since 1992 when the WP was filed. Public opinion in 2007 states the Sexual Harassment at Workplace Law must be Gender Neutral. RTI’s provided a clear insight into the government’s law making process and it has been discovered through RTI’s that during the drafting of the Sexual Harassment at workplace Bill there were innumerable representations from the public seeking to make the bill Gender Neutral. Also there was not a single comment / recommendation received from the public asking for the bill not be made gender neutral. This clearly shows that as of 2007 and the subsequent years the Indian public opinion has shifted and now the Indian citizens want this law to be a gender neutral law. The times have obviously changed and men today are increasingly falling into the trap of marital law abuse and are made victims under various different laws by their spouses or female relatives. The National Crime Records Bureau states that over 57000 husbands are driven to suicide every year as compared to 29000 wives. The rate of suicide of husbands in itself shows the changing scales as far as empowerment and need of protection is concerned. Even Law Commission in its 172^nd Report wanted Laws to be made Gender Neutral.

How the WCD Ministry trampled public Opinion in the SHWB

The below links points us to a PDF that shows the relevant areas of the RTI response received from the WCD, highlighting the file notings during the drafting process of the SHWB. The first column titled “Gist of comment/suggestion” lists the representations received from the Indian public. The second column titled “Number of comments” shows the number of such representations received and the third and final column titled “Response” lists the reply that the WCD ministry has for accepting or rejecting these representations. The PDF depicts how the WCD ministry deliberately trampled overwhelming public opinion seeking a gender neutral sexual harassment at workplace act .

From the first and second column it is clear that the WCD ministry had received numerous representations to make the SHWB law gender neutral but did not heed to any one of them. The ministry instead chose to trample all the representations by the below outrageously sexist, and statements degrading men’s modesty.

Below are the outrageous reasons for the WCD Ministry for not making the bill Gender Neutral

“The overwhelming nature of sexual harassment is sexual harassment of women on account of their female sex. Harassment of men cannot be put on the same footing character wise or incidence wise. Protection of men is also not the mandate of Ministry of WCD”.

The analysis of the statements of the WCD exposes the extremely poor and downright dubious quality of law drafting in India. Let us look at the grossly uneducated statements of the WCD one by one.

1) “The overwhelming nature of sexual harassment is sexual harassment of women on account of their female sex”

This is an unscientific “assumption” that the WCD makes. Laws are not based on assumptions but on hard facts. The WCD Ministry or the Supreme Court does not have any data to back this argument. Credible research all over the world concludes that men too are increasingly falling victims to sexual assault crimes every year. India does not have a procedure of even tracking sexual harassment crimes committed against men. However in the western world which has tracking systems, sexual harassment complaints from men who have harassed by women and other men are rising every year.

The US Equal Employment Opportunity Commission’s (EEOC) data in the below link shows that the percentage of complaints from Men increased from 11.6% in FY 1997 to 16% in FY 2009 showing that men are increasingly being victimized. The total number of sexual harassment cases in 2009 has now increased to 12,700 per year.

The percentage of men sexually harassed and their numbers (12700) is simply far too high to be ignored. Given the above data the statement of the WCD ministry does not have any credibility and is at best be termed as a poor and unscientific assumption made to create a Gender Biased law.

2) “Harassment of men cannot be put on the same footing character wise or incidence wise”

This analogy of the WCD Ministry is totally against the Universal Declaration of Human rights adopted by the United Nations. The WCD Ministry has no right or mandate to degrade the modesty of men and claim that the modesty of women is far more valuable than the modesty of men and hence idea to protect men can as well be ignored. The time has come when men and women must be afforded equal protection from all crimes in home, office or otherwise. No one can expect special pamperment based on their gender especially when data overwhelmingly shows that men too are increasingly being victimized by the same crime that women are protected against. This highly biased and sexist statement in itself is evidence enough that the law making process in the sexual harassment act was nothing more but a farce and that ministry has a biased one sided agenda which does not rely on any research on sexual harassment against men, nor does it take into account the sexual harassment laws that have been formulated by other countries.

The Government cannot blatantly ignore one gender and deny offering protection to one gender based on such uneducated and sexist assumptions which are clearly without any merits whatsoever. Hence this sexist assumption of the WCD ministry with which it has rejected the overwhelming majority of public opinion to make the law gender neutral is against the democratic law making process and cannot be accepted.

3) “Protection of men is also not the mandate of Ministry of WCD”

The above remark is an outrageously “stupid” comment and exposes the utterly poor quality of law making in India. The WCD ministry has clearly trying to incite a gender war by these statements. It is common sense that any law must be drafted by a ministry or a committee which has the mandate to protects all the sects, genders, religions or parties who can or might get affected by the law. Will the Hon’ble Prime Minister allow the drafting of a law concerning Hindus and Muslims by a Ministry that openly claims that it does not have the mandate to protect the Muslims? It is obvious that this law will be end being heavily biased against the Muslims. This is exactly what has happened here if we replace the term Hindus with Females and the term Muslim with males. Then on the same lines the Petroleum ministry or coal ministry must be given the open license to pollute the atmosphere and cause oil spills since they do not have the mandate of protection of the environment. The ministry for commerce will issue wholesale licenses for hunting Indian tigers to extinction because the protection of tigers an endangered species is not their mandate! The current law making process is somewhat similar to those during the Nazi period, when Nazis, who had no mandate to protect the Jews, drafted laws for the Jews and then called it a socialist law making to the people of the world.

Every law and action has a cause and an effect. By creating laws and not bothering about aftereffects of the same the WCD has demonstrated a fascist law making attitude.

Relieve WCD and NCW from law drafting responsibilities immediately

It is a very true statement as the mandate of the WCD does not entail protection of men, but using this as shield to create laws only for females while males and homosexuals suffer from the same crimes is beyond my understanding. So I respectfully ask which ministry has the mandate to protect men and the homosexuals. In western societies the law makers while making laws normally make gender neutral laws taking into account detailed research and statistics to first determine if the problem affects both sexes and then they formulate laws that protect both sexes. Laws on Sexual Harassment, Domestic violence and Sexual Assault are some of the laws that are gender neutral in the west. However in India the situation is starkly different. The main reasons why most new laws are horribly biased and anti male and anti homosexuals are simply because the ministry that is making the laws has no mandate to protect men and makes laws with clumsy wording and blatant ignoring of principles of natural justice and universal declaration of human rights. Also there is no watch dog to review these laws and make sure that the issues of the genders other than the female are also appropriately represented. On top of it there are some people in the WCD ministry who have vested interest and make laws which are both beneficial to their ideology and interests and also make money for their lawyers.

In order to preserve the democracy in India, after learning of the mandate of the WCD from their own mouth organizations like WCD and NCW cannot be allowed to formulate gender laws any more since they will obviously be severely biased. Laws created by these agencies are unnecessarily inciting a gender war in the country and only leading to wide scale family destruction and mutual hatred between genders.

I strongly demand that the WCD ministry and the NCW must not be allowed to formulate or have any say in formulation of laws effective immediately and all law making responsibilities must be immediately handed over to the Ministry of Health & Family Welfare which will have the mandate of protection of males, females, homosexuals and all citizens irrespective of gender and sexual orientation.

Sexual Harassment at workplace is recognized as a Gender Neutral crime the world over

Sexual Harassment at workplace crimes are gender neutral the world over since all countries recognize the fact that men and women can be equally victimized under this crime. India by making it a male only offence is taking a leap back in time. Below are some of the Examples on what is happening in other countries.

United States

The United States Equal Employment opportunity commission (EEOC) has stated that “sexual harassment filings by men has consistently increased doubling over 15 years“. Consecutively the sexual harassment page of the website of the EEOC categorically states the below statement.

“Both victim and the harasser can be either a woman or a man, and the victim and harasser can be the same sex. “

Consecutively the “Title VII of the Civil Rights Act of 1964” has the provision to protect both a man and woman against sexual harassment from either gender. Although Title VII was designed to empower women in the workplace, there is nothing in the law that limits its applicability to women.

United Kingdom and the European Union

A 2006 government study in the United Kingdom revealed that 2 out of 5 sexual harassment victims in the UK are male, with 8% percent of all sexual harassment complaints to the Equal Opportunities Commission (Britain's EEOC), coming from men. The UK’s “The Equal Opportunities Commission's Code of Practice on Sex Discrimination” clearly spells out that protection from sexual harassment protection is available for both men and women. The European Commission's code of practice on the Protection of the Dignity of Women and Men at Work is used to protect both men and women from sexual harassment at employment.

Sexual Harassment against men goes even more underreported as compared to women

Sexual harassment against men is vastly underreported because most men would never complain or file a lawsuit because of the fear of embarrassment or stigmatization. But this is changing with time. Recent improvement in sexual harassment training, reporting procedures, and “No Retaliation” clauses in the west have probably contributed to an increased likelihood of men also coming forward to file a claim.

A recent wall street journal article titled “More Men Make Harassment Claims” on March 23, 2010 reported the below.

“Stephen Anderson, president of Anderson-davis Inc., a workplace training company in Denver, says filing a claim is often a no-win situation for a man.” If a woman is harassing you, people might think 'What is wrong with you? You should be flattered,' “he says. In cases where another man is the harasser, the victim might be afraid that he comes across as unmanly or homosexual, he says.

“The EEOC doesn't track the sex of the alleged harasser, but Ms. Lisser says the EEOC has observed an increasing number of men alleging sexual harassment from other male co-workers—and not as many cases of men accusing female bosses or co-workers of sexual harassment. Employment attorneys have also seen an increase in man-on-man harassment complaints.”

“Companies have educated employees about sexual harassment for years, but some are making their messages more male-focused to safeguard themselves from potential litigation. Freada Klein, a workplace bias expert in San Francisco, has been advising companies to add examples of sexual harassment levied against men to their training and education programs. She encourages clients to bring up scenarios like public humiliation, bullying and inappropriate banter. "More types of behaviors are put in the sexual harassment bucket when men are the victims," she says.”

The Homosexuality angle has been ignored completely

Homosexual sexual harassment has been documented worldwide and occurs on a large scale in all societies but is never talked about too much. India too has a large number of homosexual couples who lived in the shadows earlier, but now with the Honorable Delhi HC decriminalizing homosexuality there will be a huge increase in male-male and female-female relations in offices too. Sexual harassment at workplace can also happen between two individuals of the same sexual orientation and this bill does not address this in any way. This bill does not have any provisions to protect homosexual men or women from harassment from their same sex partners.

The sexual harassment at workplace must be amended immediately to make it Gender Neutral

There is no doubt that the WCD ministry has deliberately ignored sexual harassment laws the world over, nor has it used credible research on sexual harassment laws and statistics which are easily and widely available, to learn and understand that this crime is gender neutral. I hereby most respectfully reiterate my demands that the firstly WCD Ministry and NCW must be relieved from law making with immediate effect and be replaced by Ministry of Health and Family Welfare and secondly men and homosexuals must be offered equal protection under the sexual harassment at workplace act and thus the bill must be amended to make sure that adequate language in incorporated to achieve the same.

TADA and 498A are more or less the same legal framework , if TADA can be repealed why not 498A ?

Below are the relative comparisons of the Indian TADA and IPC section 498A. It is amply clear hat both laws have the same legal framework like considering the accused guilty under proven innocent and arrests without evidence or investigations .They have led to the same type of human rights violations although human rights violations in 498A have been far more severe and devastating. So why was the TADA law allowed to be repealed and the government is hesitant in repealing or amending section 498A. Has militant feminism today become even more powerful than actual militants? The definition of Terrorism

The term "terrorism" comes from the French word terrorisme, which is based on the Latin verb terrere (to cause to tremble). It dates back to 1795 when it was used to describe the actions of the Jacobin Club in their rule of post-Revolutionary France, the so-called "Reign of Terror". Jacobins are rumored to have coined the term "terrorists" to refer to themselves. Terrorism refers to a strategy of using violence, social threats, or coordinated attacks, in order to generate fear, cause disruption, and ultimately, brings about compliance with specified political, religious, or ideological demands. Terrorism can be used by motivated individuals or organizations to disrupt an existing process and make other individuals or government give in to demands which under normal circumstances cannot be met . Terrorism under TADA normally referred to misuses of weapons like rifles , RDX etc while Terrorism under 498A referred to the use of the state machinery to wreck havoc on the opposite party to force them abide by unreasonable demands .

How are TADA and 498A similar ?

The carnage of TADA

The Terrorists and Disruptive Activities (Prevention) Act (TADA) was created in 1985 (amended 1987) . The abuse of the act led to led to tens of thousands of politically motivated detentions, torture, and other human rights violations. TADA was as a tool to fight trade unions and to detain Muslims, Sikhs, Dalits, and political opponents. Over 76,000 people were arrested while TADA was in force from 1987 to 1995. The conviction rate for these arrests was less than one percent Out of 200 people charged under TADA only one person will be convicted, which just proves how unfair and ridiculous the Act is. TADA allowed for people to be detained in police custody for up to six months without charge or trial. Data gathered on 1997 said that as of August 1997 there were there are an estimated 65.000 TADA detainees in Indian prisons. The detainees and their families go through so much unnecessary heartache and suffering. This Act can in many ways be seen by some Muslims as prejudiced for example in 1995, 228 TADA cases were registered in Rajastan, 101 were against Muslims, 96 against Sikhs and 3 against Hindus. There is no bail under the TADA Act and appeals can only be made to the Supreme Court in Delhi. Thousands of people are unfortunately precluded this right as the court is in Delhi, families would have to undertake very expensive long journeys. To obtain a lawyer for the Supreme Court the minimum cost would be RS 250.000, which is £4.200 a large amount to raise even by western standards. The TADA Act is against one of the basic points of the Indian Constitution, that a person is presumed innocent until he is proven guilty. TADA presumes that people are guilty until they are proven innocent.

The carnage of 498A is still ongoing

If abuse of TADA equal that if a carnage then abuse of 498a approach that of a genocide .Section 498A was inserted into the penal code in 1983. The abuse of 498A leads to more than 75000 cases being filed all over India. 498a is used by motivated and bloody minded wives to misuse the Indian state machinery to arrest her husband and his entire family and then make them agree to unjustified demands or face jail time. Just like TADA , 498a also considers the accused to be guilty until proven innocent. Over 126000 women and children and 3 million men have been arrested without any evidence or investigation under 498a. Over 56000 husbands have been driven to suicide annually due to the misuse of these laws while. These people languish in jails and police lockups for days on end. Just like TADA was looked upon as prejudiced against Muslims, 498a is completely prejudiced against Husbands and their families. The Police never register a case for giving dowry as has been mandated by the law under section of the Dowry Prohibition act but immediately arrest the husband and his family under allegations of taking dowry. Like TADA victims of misuse of 498a have to battle false cases against the government of India for decades on end that cost their life savings. The wife and their families do not have to spend any money as the government draws from the tax payers money to fight their false cases also causing a huge loss to the nation. The conviction rate in 498a is even lower than TADA. Cases where 498a alone is used the conviction rate is close to 0% .The overall statistics says that over 98% of 498a cases are false to begin with . The supreme court of India has called misuse of 498a as legal terrorism.

Why is 498a more dangerous than TADA?

1)498a is state sponsored terrorism .Indian State itself provides the weapons of terrorism in the form of laws. The government provided law is a weapon of terrorism.

2)Indian state spends exchequers money to fight false cases. This is leading to massive loss of revenue which could have been used in a better way to improve judicial infrastructure.

3)Government lacks commitment to fight legal terrorism unleashed through misuse of section 498a even through it is clear that 498a is a lot more deadly than TADA when misused.

The Honorable Indian Minister for home affairs was asked the below questions on abuse of the dowry law . Before we even go into the questions and the home minister's answer , we need to know that the home minister along with his wife are both very learned and eminent lawyers and understand the Intrcacies of marital and dowry laws better than anyone else. The home minister's wife was also involved in the High profile 498a case of Tamil Actor Prashant in 2007.

SHRI P. CHIDAMBARAM: I think I have already answered the question in part. I do not subscribe to the proposition that in most cases of dowry deaths, the provision is misused. That is not true. I gave you the numbers of cases that were registered in the last three years. Look at the number of people convicted. In 2006, 5144; in 2007, 5580 and in 2008, 5814 persons have been convicted. It may be true that in a few cases, indiscriminately, people may have been arrested and there may be some harassment but that is not true of the large number of cases. Therefore, we have advised the police that where a dowry death case is registered, they must exercise their discretion and arrest only those who appear in the investigation to be directly connected with the dowry deaths and not the extended family.
That advisory has been given. But I think on balance this provision is a salutary provision; a new offence has been created; people have to be punished when they kill young wives. If in a particular case there is an excess, there is a court system which will correct it. But to go, as I said, from one position to an extreme position and say there is massive misuse of this provision, Madam, with great respect, I beg to disagree.

How the legally educated home minister dodges the question
1) Section 498A and Section 304B are as different as chalk and cheese . 498A is the law that is invoked when a woman "claims" that she was harassed . This is the law that is most misused since it has got arrest on demand provisions and no investigations or evidence is needed .Looking at the severity of the misuse the supreme court of India has called the misuse of section 498a as "Legal Terrorism". Section 304B is invoked when it is proved that a woman has been killed because to dowry .Section 304B requires a lot more evidence and proof and misuse is difficult since it is a life and death question. The honorable Lok Sabha member had clearly asked the Home Minister if section 498A needs to be amended due to its misuse and if not why ?

2) It does not take a legal degree to see that the Indian home minister very cleverly dodges the question on amending 498a and replies on why section 304B is must not be amended instead. He says " I do not subscribe to the proposition that in most cases of dowry deaths(a.k.a section 304B, not 498A), the provision is misused. That is not true. I gave you the numbers of cases that were registered in the last three years. Look at the number of people convicted."

Honorable home minister , why are you answering if 304B is being misused or not when the question clearly asks if 498A is being misused ?

The Home Minister the proceeds to state numbers for section 304B when the question asked was completely related to section 498A .

This is tried and tested trick that many feminists use when asked if 498a needs to be amended. They immediately switch the conversation from 498A to 304B and justify the existence of 498A because of a crime which comes under section 304B. , which is exactly what our lawyer Home Minister did here . For the nonlegal professional who does not understand the difference between section 498A and section 304B the answer of the Home Minister will sound totally credible .

3) Also notice that the Home Minister also quotes not the "number of convictions" under section 304B ( which is firstly irrelevant to begin with since question was on 498A ) but the "number of people" convicted under it. This was done since the number of cases and convictions under section 304B are too less to portray any serious threat of dowry death .Considering that single conviction results in 4 people getting jailed then the total number of conviction would be no more than 1500 .The Home Minister knows this and hence quotes the "number of people" getting convicted and not the number of "convictions". Being an eminent lawyer himself he should have known better.

How committed the Indian government really is for eradicating dowry?

1) The WCD has not spent a single Rupee on stopping dowry exchanges and extravagant marraiges ,while Pakistan has started the one dish law to eradicate extravagant marraiges in their country.

2) Instead of stopping dowry the government is openly encouraging dowry loans. Government owned State Banks create loans specifically for paying marraige expenses of women and paying dowry.The state bank of Hyderabad Kanya Vivah Suvidha Scheme is one such example of how Dowry loans are openly available from Government banks.

3) The Home Minister dodges questions on 498A abuse and gives a totally irrelevant answer related to section 304B.

4) The Indian President ( who is herself a woman ) who normally gives many lectures against dowry attended the wedding of her nephew where huge dowry was allegedly exchanged . The President's own nephew is a facing a 498A filed by his wife . The President's nephew's wife who has filed the case has alleged that she had approached the India president many times to seek help but did not get any response. The wife has further stated that had also tried to contact the president through the president's husband but to no avail.

Once in a Lifetime data gathering techique is totally DUBIOUS

People who follow the $1 billion Domestic Violence industry may notice that even in India women’s organizations have started to present Domestic Violence statistics in Once in a lifetime statistical method. Below are some links that highlight this method in news reports .

The above report says that 30% of women (or to make it sound more serious 1 in 3 ) face domestic voilence "once in their lifetime" . To the common untrained mind this method may sound very credible and normal, but is it really so ? Lets look at the example below to find out.

The Claim

Let’s start with an oft quoted statistic: - 40% of women have been suffered Domestic violence at least once in their lifetime. First you see the time line has been extended from 2 years to 5 years to 10 years and now the whole lifetime . So how does this whole lifetime timescale benefit the feminists?

The Analysis
1) This means a woman ( Lets call her Savithri ) who has encountered DV in 1980 will also appear in this data , although she might not have encountered any violence for the past 30 years . That means if we plot the occurrence of DV on the Y axis and Timeline on the X axis then there will be only one occurrence of DV on the graph 30 years ago. So this method of representing data in order to give a false sense of frequency of occurrence increases the time scale enormously which is wrong .

2) Now Savithri's data will keep appearing in this DV victim list until Savithri dies in say 2040 at the age of 80 . So the DV data will still look high since until Savithri dies her data will remain valid. Savithri's data will only disappear when she is dead and she has no way to report that she has harassed once in her lifetime back. So the one data is kept alive from the time of occurrence of the act to the time the person dies. This in no way gives a true representation of the seriousness of the problem , in turn it tries to create false and bloated numbers which are essentially false. A person might have been afflicted by smallpox in 1960 , however small pox is now eradicated from the planet. Can we say at least 40% of people alive today faced smallpox at least once in their lifetime?

3) Lets assume for one second that Savithri was really beaten. But Savithri was beaten in 1980 it has been 30 years and there has been innumerable laws and legislation's passed against DV and harassment. However let us assume that in 2005 we have passed a DV law which was like a silver bullet and eliminated all DV in India. Even though today in 2010 DV is completely eliminated an there is no real need of the DV law , Savithri's Data from 1980 is used to show DV statistics . So until Savithri's death in 2040 it will shown that there are women who have faced DV( once in their lifetime) and hence there is need for the DV law . Speaking in different terms this means that even though the smallpox vaccination eradicated the disease from the face of the planet , the data gathering methodology ensures that it still shows up for a very long time . The effect of the remedy of the solution is very effectively eclipsed due to the data gathering technique used .

4) So you see how the argument of having faced DV once in a lifetime is used to show data that is not relevant , but for the non-mathematical common man this looks like a significant figure .

Did Savithri tell the truth ?

The question also remains that did Savitri really tell the truth about Domestic Violence? With over 98% of all 498a and about 80% of all DV cases turning out to be false can we really even believe Savithri when she claimed that she faced Domestic Violence in 1980 .

Now it is left to the intelligence of the readers , how the data gathering techniques are used to essentially fudge numbers in order to attract funds for Domestic Violence . In order to get a true representation of the problem DV stats must be gathered year wise or month wise and only based on convictions and not complaints.

Dowry & Extravagant marraiges affects fathers of the brides , the most

We hear many women's organizations clamoring to get media attention for eradicating dowry. However they ignore the very basic fact that ultimately the daughter is just the receiver of the dowry and the actual dowry giver is ultimately a man who may be the father/brother of the bride. These males in the family work hard and spend their life’s savings to ensure that the women of their family can have a wedding of their dreams. Many fathers spend their entire PF savings and retirement benefits at the weddings of their daughters. Societal pressure accompanied with an zeal to outdo others drive these families to spend their way into bankruptcy in weddings. Many fathers are left with little or nothing left for their old age.

Whereas everybody sympathizes with the bride as a victim of dowry , no one sympathizes with the father or brother who loses his life’s savings and has little in his old age for himself and his family after spending on a extravagant marriage. So the first question we need to ask is that is the daughter the real victim of dowry or is it another man?

What has the government done so far to eradicate extravagant marraiges to reduce the burden on the bride's fathers ?

The Dowry Eradication Scam

The Women and Child Ministry and the National Commission of Women claim that they have been "hard" at work to eradicate dowry by promoting laws like 498a and DV act etc . However the most easiest way to achieve this is to is to Ban or stop promoting extravagant marriages and punish and ostracize dowry givers . However doing this will anger the marriage industry which the government does not want . The Indian marriage industry today is more than Rs 600,000 crores ( that’s about $ 150 Billion ) and no politician wants to touch the donations they get from this industry.

Lets "Decreases" the punishment for Dowry givers seems to the recommendation of the WCD Ministry

The WCD ministry naturally to protect such a big industry on one side has proposed an outrageous recommendation that they will propose to reduce the punishment for Dowry Givers . It is to be noted that even though there is punishment recommended in the Indian Penal Code for givers , not one woman or family has been convicted for giving dowry as of now. However the WCD ministry wants to believe different and knows that if Dowry is eradicated so will the Indian marriage industry and is working head over heels to safeguard it .

Advertising Budget shows the true reality of WCD ministry's commitment

Eradicating dowry speeches are normally given very passionately amongst foreign delegates in 5 star hotels , all the while chomping on exquisite cuisines. at the tax payers money . However you will find the same ministers and government appointees drinking imported alcohol and dancing at extravagant weddings the very next day forgetting that if the marriage fails whatever has been spent will be called dowry. They also forget that that India has a law against giving dowry which needs to imposed .

The Women and Child development Ministry website on media activities shows that during the fiscal year of 2008-2009 they spent about Rs 52 Crores on advertising .

Out of the 15 advertisements issued in the print media 4 are exclusively for the Birth and Death anniversaries of the members of the Ruling Gandhi Family . I cannot help wonder how that helps women and children of India and why is the WCD Ministry even celebrating or mourning the deaths of the members of the Gandhi Family ?

From the 52 crores they have spent so far , not a single rupee for any sort of advertisements for eradicating dowry , eradicating extravagant marriages , or creating an anti dowry hotline where exchange of dowry can be reported and givers and takers can be punished right there. An RTI was filed with the WCD ministry (see RTI response below) confirms this hypocrisy .The Ministry replies that they have spent NIL amount of money for advertising campaigns aimed at eradicating dowry and/or extravagant marraiges.

The questions remains that why has the government on one side tried to protect the marriage industry and allowed it to balloon to such mammoth proportions by allowing extravagant marriages on one side and draconised and the existing laws to show a facade of commitment to eradicating dowry? The truth of the matter is that in order to safeguard the marriage industry and the industrialists benefiting from the marriage industry the WCD ministry or the government has never stopped extravagant marriages , instead it allows the money to be spent first and then rants that dowry has been exchanged and penalizes the husband and his family. This double face by the WCD clearly shows dubious intentions.

How is Pakistan Dealing with the problem

Pakistan and India having originated from the same subcontinent 50 years ago also deals with the same problem , however the Pakistanis have found a very effective solution to curtail extravagant marraiges by implementing the one dish law.The one dish law legally controls extravagance weddings , cointrols dowry giving and provides relief to the family of the brides from spending their life's savings on marraiges .

The One dish law legally limits the numbers of dishes in any wedding to only one . Pakistan in order to save the tax payers money and provide relief to the poor masses, has made it mandatory that not more than one dish will be offered during any function, including wedding ceremonies. The Indian government should stop ranting about dowry and just implement the one dish law in India too to eradicate dowry once and for all . Lets hope what Pakistan has thought today India will think tomorrow.

Pakistani Cricketer now faces Indian State sponsored terrorism

Now it is Pakistan's turn to face Indian State sponsored terrorists . No not one with Guns and Suicide belts , but women with biased Indian marital laws . Pakistani army is on one side fighting the Taliban on the western front and now a Pakistani cricketer is facing the Indian female Taliban in Hyderabad . You guessed it right , section 498A( The Anti Dowry law ) whose misuse has been called "Legal Terrorism" by the Indian Supreme Court. The cricketer's who was in India was tricked into marraige by one named Ayesha who has clearly tricked the Pakistani cricketer into marrying her. The cricketer has said in a press conference that he was shown photographs of a different girl and unattractive the girl in question(Ayesha) had always claimed that she was the elder sister of his so called wife. Now Ayesha has claimed all of a sudden that she is in fact his wife and althogugh he has not seen or met her in over 8 years she has filed a case of dowry harassment against him. The Hyderabad police acting on the woman's complaint has seized the cricketer without any evidence or investigation and has questioned him for over an hour . If this is the treatment that a celebrity is given then one can assume what a commoner goes through when he is slapped with the unconstitutional 498a .Almost every top body in India from the Supreme court to the President to Hundreds of Social bodies and well known people have asked for the law to be scrapped / amended , but the government has so far paid lip service . We demand that the 498A law be immediately scarped because it is nothing short of Legal terrorism and is used as a license to harass husbands and their families

Babu Bajrangi comes to the aid of parents of such truculent girls and he takes particular interest if the girl has eloped with a Muslim boy. He even sends goons to neighbouring states if the girls have escaped there. If threats and thrashings do not work on the boy, they kidnap the cupid-struck couple, often by bribing cops. After receiving the 'proper treatment', the girls are married off to the 'betrayed' Patel boys. Babu Bajrangi, the crusader, boasts of scores of successful missions to his credit and is defiant about the cases files against him. He knows the laws protecting individuals from onslaughts of the kind he engineers, are toothless. In any case, he can well take care of big babus and judges and it helps that even the local media is sympathetic to this noble Talibanism. On the other hand, another kind of Talibanist activism has the backing of such provisions as Section 498A of the Indian Penal Code. Arvind Chirag Patel, who lives in a posh apartment in Western Ahmedabad, realised it the hard way on July 12. Anyone who thought that the Ahmedabad police were extremely busy cleaning up the supply lines of illicit liquor after last week's tragedy, should know that, in reality, matters are quite different. Take the following case: Arvind had a love affair with Jyotsna Barot in the mid-1990s but their parents did not agree to their marriage. In 1996, his parents arranged his marriage to Nita, whose parents stayed in Mumbai. The arranged marriage did not turn out to be successful as Nita preferred to live with her parents in Mumbai rather than in the less-urbanised Ahmedabad. Their marital life had been adversely affected as a result. Neighbours of Arvind informed Nita, who had been accusing her husband of having extramarital affairs with several women, that he brought other girls to his apartment. She soon came over from Mumbai to keep a check on him. On Sunday, when he left the apartment, they followed him in another car. He drove up to his ex-flame Jyotsna's house and picked her up. As the two stepped out of the car, Nita alighted from her car and confronted them. Her relatives dragged the duo to Vastrapur police station near IIM. A complaint of cheating was booked against the man as he had been caught red-handed practicing adultery. The bravery of the courageous woman from Mumbai was hailed in local editions of the national press. It is pointless trying to figure out under what law a poor man, whose wife prefers to live with her parents, can be arrested upon being caught red-handed spending time with a girlfriend. The cops have the right to take their own sweet time in dealing with a complaint filed against him under India's Dowry Prevention Act. It may take any number of years for the charges to eventually be dismissed as that of a harangue of a nagging and psychopathic spouse. Babu Bajrangi is a 'social worker' who has his own resources for running his noble services and only accepts voluntary contributions from his resourceful beneficiaries for maintaining his Taliban-type outfit. From the way Nita's bravery was hyped in various newspapers, her relatives come across as the kind who are resourceful enough to make voluntary contributions to the facts of the case. It must be noted however that in this case, the policemen, noted for their legendary resistance to entertain complaints, were only too gracious when it came to indulging in this type of Talibanist activism. Particularly if the man is rather well-to-do, a sizeable ransom can be extorted from his family through repeated harassment. Under the anarchic provisions of IPC Section 498a, they would be at the mercy of such 'guardians' for months and years till the complaint is disposed of. their legendary resistance to entertain complaints, were only too gracious when it came to indulging in this type of Talibanist activism. Particularly if the man is rather well-to-do, a sizeable ransom can be extorted from his family through repeated harassment. Under the anarchic provisions of IPC Section 498a, they would be at the mercy of such 'guardians' for months and years.

Legal Terrorism in India is defined as wives / women misusing marital/ women centric laws against their male counterparts to extort money/benefits.This phenomenon is spreading like an uncontrolled cancer in the Indian society today with millions of innocent men being victimized . With more than 56000 husbands driven to suicide every year , men’s rights groups normally resort to blaming the militant Feminists , the biased laws and the apathetic Indian Government for the flourishing Legal terrorism industry in India . However apart from significant contribution of these agencies the Husbands ( and Men ) themselves also play a the role of very significant catalysts in this industry .Indian Males need to be sensitized to these issues right from childhood and must be taught that they too can become victims at the hands of a woman. Traits like chauvinism , protector , provider must be shunned by males all over since these are the roles that prevent males from speaking up against spousal abuse. Men must me learn to scream/wail at first chance just like women do . Men need to a learn of behavioral traits from women themselves if they are to survive in a increasingly biased world of feminist hegemony.

A lot myths drilled into Indian boys as then grow up to become men are the primary cause why men resort to taking their own lives when faced with Marital Terrorism. Below are the most important myths that Indian men have which are shattered in quick succession when they are faced with a legal terrorist.

1)India is a Male dominated Society :- Indian husbands are brought up thinking they live in a male dominated society. This leads them to have a feeling of invincibility until they are entangled in legal cases and the government forcibly castrates them in court. Right from King Shantanu to King Dasharat faced life long sorrow and troubles because of the irresponsible behavior of women in their lives. However men still believe it is they who dominate.

2)Indian men feel women are the weaker sex: "The facade of weakness is a Woman's biggest strength." With 11,000 crores( $ 2.5 Billion ) of annual funding and 13 explicit laws for women, women are not the weaker sex by even a far cry. However Indian males are feeling still not able to shake of this is by far the biggest reason that men are victimized. Indian Men are unaware that right from the Indian home ministry to the Indian finance ministry shudder at the thought of Militant feminists and are willing to go head over heels to appease them first. This is not an exaggeration but the brutal reality.

3)Men do not even realize they are the victims :- Indian men do not even realize that they are the real victims . So deep rooted are the feeling mentioned in points 1 and 2 that even when a male has been made to pay through his nose , he still feels that he dominates the society.

4)Men always ignore the telltale signs:- My Wife can only so do so much , so lets not bother , is what Indian Males feel till they are hot by legal terrorism . A Legal terrorist almost always provides many telltale signs before it actually attacks. Indian husbands almost always ignore these signs and do not realize they are the going to be in the crosshairs of a legal terrorist.Instead of safeguarding themselves before even the terror attack takes place Indian Males prefer not care.

5)I am a Man, I need to fix my problems myself:- Unlike women who want their fathers , families and government intervention to resolve most of their problems , men are programmed to resolve their issues on their own. Indian Males who see other men being victimized do not approach to help them (unlike women ) as men feel that it is below their dignity or manliness to help other men. The Male who gets victimized also feels that it is below his manliness to seek help. Most men feel they can handle it own their own , when the reality is that they do not know the seriousness of the matter and prefer to believe that it is a shame to speak publicly about the Domestic Violence or Emotional/Verbal /Physical/Financial abuse they suffer at home.

6) Men do not Speak up :- Women cry rape even they have not been raped , they cry domestic voilence even when spoken loudly to. However most men undergo legal rape in courts and police station at the behest of their bitter halves but still remains silent and prefer not to speak up . The reason this happens is that males are emotionally castrated from childhood and are taught that being a man means swallowing your pain and display and outwardly state of calm. The Indian Society will change and become cognizant of the problems faced by males only when men start to speak up and scream rape just like women.Men who silently suffer are the ones who prone to suicide. Even the suicide of men normally goes in vain. The sympathy of the society lies with the women again and she is showered with widow benefits . The Indian government does not even investigate the reasons why 56000 husbands commit suicide every year and brushes them under the carpet.

7)Escapism (Let me Pay and Settle) :- Men who prefer to “settle” instead of "fight" are the ones fueling the legal terrorism and extortion industry. India too like a meek husband has tried to settle the issue of Kashmir for the past 50 years . Has it helped ? Will India ever pay the territory of Kashmir to the LET and “Settle“ the case , if NO then why do husbands reward their legal terrorist wives to settle ? The simple reason that men pay is the sole reason that women extort. Negotiating with terrorists weather with gun or a law is not an option. Settling and rewarding the terrorists does not lead to peace it leads to further bloodshed on others , because if one terrorist succeeds then others are prompted to turn into terrorists themselves . If men stop paying a penny , or adopt a no settlement policy , then automatically legal terrorists will be unable to extort.

8) Defensive attitude :- Wives always play offensive and husbands play defensive in matrimonial matters. This is also partly true because of the biased and one sided judicial system in our country and unavailability of male protection laws. However even with the available options men prefer to settle the case and pay up rather than attacking the legal terrorist and punishing her.

10) Forgiveness/ Marry an Ex Terrorist :- "What if a woman has filed 498A , Maintenance and DV cases , let me forgive her and live with her again" or "What if she has used this laws in her last marraige she will not do it again" . While the conviction rate of a first 498A offense is less than 1% for the second offense it rises to 90% .This is because the even the anti male Indian courts are not able to understand the reason why a husband who was victimized before chose to live with the same woman again.While nothing is more stupid that living for the second time with wives like these , Males seeking second marriages also MUST steer clear of women who have used of any of the laws above. These laws have no place in a marraige and women who have used these laws have done so only to misuse them. Only when there is social ostracization of women and their families who misuse these laws will there rise a conscience and fear amongst people who misuse these laws .

10)The law will do me justice: - And finally The Biggest myth of all . Unless a husband has stepped into a criminal court in a 498A case or a Family court for a family case, he believes and trusts in a myth that the courts will give his justice and relief. Once he lands in court he is shocked to see the terrible bias against husbands in . The wife can and will get away even if she commits the most heinous of crimes . The courts will ALWAYS rule in the wives favor even if all the evidences and arguments favor the husband. The wives can commit hundred cases of perjury but the judge will rule that he will not prosecute the wife because it is not "Expedient for Justice" .The Indian judges are programmed to act as the wives’ lawyers and husband is not provided relief in any case. The Husband is considered to be the culprit unless he is proven innocent. Weather it is in a 498A or Maintenance or divorce, the husband is always on the receiving of the justice end in court. Even after 17 years of fighting a divorce case a male Supreme Court judge in India told a husband to listen to his wife even when she spoke nonsense. The earlier the husband understands the terrible anti husband bias, the better he can plan his battle.There is no justice that husbands can expect from courts.

Mother in laws from Nagpur have united under the All India Mother-in-law Protection forum to demand their rights as women on the upcoming International Women's day.(IWD) .The Mother-in-laws demanded protection and creation of laws which protects them from harassment from their daughter-in-laws apart from demands to make marital laws gender neutral offering equal protection to women from the husbands side also. They also demanded that the women’s commission treat complaints from mother-in-laws with equal importance as they treat complaints from daughter-in-laws. Indian women’s' follow a highly anti-male approach and do not entertain complaints from women unless the complaints is against a man. The Indian police on the other hand holds the dubious distinction of arresting over 126,000 women without trail or evidence in the last 4 years alone under the draconian 498A under the guise of women empowerment.

The Money
The Indian media is clearly scared in publishing issues concerning men and men’s rights lest it rubs the women’s organizations the wrong way. I was very disturbed to see that even when the article is completely about men’s suicides there is a “pacifier” line in it at the end that although men are committing suicides at a rate 100% more than women, women are attempting suicides more than men. These types of “pacifiers” originate to keep the women’s organizations calm. The talk about women’s rights has today become so politically correct that to even talk about men’s rights and how men suffer is seen as a threat to women. There is an unwritten rule in the media that women can never be made the oppressors, or they lose their advertising revenue. The militant women organizations are funded by the all powerful WCD ministry in Delhi with a annual budget of Rs 7500 crores and the media houses all get a significant part of this money in the form of advertising expenses which the media houses clamor for (remember the National advertisement from the WCD ministry in all news papers carrying the picture of the Pakistan Air Chief).
A newspaper does not run on news , it runs on advertising and the government is a big subscriber to advertising for spreading its message and the newspapers do not want to rub the WCD ministry or any women’s rights organizations the wrong way . This is exactly the reason why there is an urgent need for a men’s welfare ministry along the same lines as the women’s ministry so that the media can then get revenue from both these ministries and cannot be gagged with the lure of advertising revenue like it is now. The media can then truthfully expose the carnage of men that is today taking place in the name of women empowerment.

The Militancy
While the media and the press is centrally controlled through huge budgets the other areas of the society which cannot be controlled monetarily are controlled through feminist militancy . Militant women's organizations control the state machinery like Police , the Judiciary , the law and order system and ensure that women committing an offense are not implicated of the same . That's why we see police refusing to file cases of giving dowry , Judges refusing to prosecute women of perjury or adultery or misuse of laws and are restricted to reprimanding the government and lower courts at the most . We have come across cases where judges , police officers and the members of the law commission have confessed that they are very scared of the response that radical women’s organizations will take if any men’s reforms are introduced.

We all remember the ridicule the then law commission chairman had to undergo in 2001 from these militant women’s organisatons when he recommended section 498A to be made bailable .

There was also a protest by the same militant groups after Justice JD Kapoor made some very harsh statements against section 498A in 2003 .

The Home ministry recently admitted that they were unable to introduce reforms into section 498A because of the oppositions from women’s groups .They however did not name the groups , nor did they describe the kind of opposition they were facing.

How the Indian government imported Weapons of Male destruction(WMD) from the United States

The word “Domestic Violence” is a relatively new phrase coined by America just like many other phrases like Weapons of Mass Destruction. The word Domestic Violence if used a few decades earlier in India would have evoked raised eyebrows and strange looks because no one would have really understood what it really meant . Indians were more used to the word cruelty., which although was still not measurable but had a higher threshold as compared to Domestic Violence .

The Domestic Violence Ideology – America’s Weapons of Male Destruction (WMD)

Domestic Violence is basically used as an ideological weapon. A Weapon whose effects are far severe and deadly than the most nuclear weapons. These ideological weapons once experimented can cause irreversible damage to the social fabric of a country. India today is one of the biggest importers of this US ideological weapons . The US family system as we all know is broken beyond repair, over 50% of marriages end in a divorce and over 21 Million children are fatherless. The separated and broken families lead to a high crime rate and consequently the US has the highest percentage of people in jails as a ratio of its population as compared to rest of the world. The single family mothers once separated demand every increasing benefits like there is no tomorrow and the US government is borrowing at an increasing rate to extend all sorts of benefits to these broken families. As of today the United States is sitting over $ 12 trillion dollars in debt (rising every second) which means every American owes approximately $40,000 to the world in debt , apart from his personal debt. Right from the multiple wars to the Government services, everything is financed from the every increasing US debt.

So why is a country which itself is mortgaged to the hilt suddenly extending financial aid to domestic violence victims over the world , unless it has a hidden agenda ? Why is countries like China , Saudi Arabia , Japan or Russia who are far better of that the US in financial terms not exporting these weapons like the US ? Would we have give the same importance and interest had these laws been imported from these countries . The Domestic violence ideology that the US has exported if looked carefully has no reference to protecting the family system of the society.It does not speak about keeping the family united , or protecting a person’s civil rights , or about female or mutually initiated violence . In the domestic voilence ideology only the male can be at the receiving end of all laws . What the domestic violence ideology speaks for is simple and that is under the veil of protecting women from domestic violence the government increasingly is allowed to poke its nose into family affairs of ordinary people which ultimately leads to the family breaking up and men paying women from their own incomes and the government allocating funds from the tax payers income to provide and protect these women thereby leading to the creation of a whole new industry in itself.

The Indian Tamasha

The word "Tamasha" in Hindi means a false drama. India has had domestic violence laws since 1961 which prevented a husband from demanding money from his wife or her parents. India also created a new section for preventing domestic violence in 1983 with aims to prevent cruelty to women. As a consequence we had a lot more data and results from the implementation of these laws. These were however not called Domestic violence acts because the word was not coined by our American friends until then. They were rather called laws to prevent cruelty.

The Domestic Voilence Drama unfolds

The initiation of the conspiracy began in 2005 when a very prominent US newspaper The Washington Times published a report from United Nation Population Fund (UNPF) which stated a rather shocking statistic that more than 70% of women in India faced domestic violence. This meant that over 350 million women in India faced domestic Violence. The report is published in the link below. U.N Population Fund's claim that "70 percent of married women in India were victims of beatings or rape" is founded on surveys by women's advocates that are neither consistent nor scientific. Let me demonstrate the feminist rumor mill in action right before your very eyes. The study "Profiling Domestic Violence: A Multicountry Study", by Kishor and Johnson, is heavily cited as the basis for positions adopted within the UNPF report. To my knowledge, the Kishor study has not been subjected to peer review. Nonetheless, the convenient parts were extracted for the purposes of the UNPF report.

However within days of publishing the report there was a lot of noise being generated on the credibility of this report and the way the data of the report was published . Looked at from any angle the report showed signs of data fudging and misrepresentation of data which are the hallmarks of militant feminist ideology.

A mere look at the report shows that the Y axis of the report does not consist of a normal section of people chosen randomly . When looked at carefully the Y axis of the report consists of DV complainants themselves. This is like asking 100 Indian car accident victims if they have ever had an accident and then claiming that 100% of Indians have a car accident every year. Even a child in the V std in an Indian school would get a ‘very poor’ comment from his teacher for such data analysis.

On 26 October 2006 the then Minister for Women and Child development quotes the above false and fudged numbers and states “We have been trying for long to protect women from domestic violence. In India alone, around 70% of women are victim of these violent acts in one or the other form”.

On 19 November 2006 David R Usher provides a scathing rebuke on UNPF report on exposes type of data fudging that was used to come up with such numbers.

On 29 Nov 2006 The Washington Times Posts a correction stating that the “Using a chart published in a 2005 U.N. Population Fund report -- which the U.N. agency now says was misleading – a London Daily Telegraph article published in Nov. 13 editions of The Washington Times incorrectly stated the frequency of wife abuse in India. The agency says that it does not have sufficient data to provide such a figure and that the chart was intended to show that 70 percent of Indian women who were abused by their husbands think such abuse is justified in at least some circumstances."

The Indian government or any of its ministers who earlier made many comments on the claims of the report now make no comments or remarks on the completely debunked UNPF report or the law created in India based on these type of false numbers.

What does peer review say ?

Peer review (also known as refereeing) is the process of subjecting an author's scholarly work, research, or ideas to the scrutiny of others who are experts in the same field.

Murray A. Straus ‘s published a review published in 2008 titled “Dominance and symmetry in partner violence by male and female university students in 32 nations” . This article reports the results of an empirical investigation of two of the most controversial and important issues in understanding physical violence between partners in marital, cohabiting, or dating relationships.

The report in Page 261 quotes the prevalence of bidirectional of severe physical violence and has the numbers for 32 countries. The numbers for India are as below.

11.9% of Indian couples face domestic violence ( slap , shove , grab , throw etc )
15.3 % of times only the Male is violent
23.0% of times only the Female is violent
61.5% of times both are violent

The Indian numbers are almost similar to global average.

What do the Indian DV laws say ?
Even though the report of UNPF has been clearly debunked as nothing more than a example of feminist data fudging and the MA Strauss report for 32 countries shows that chances of a female being violent is clearly more than that of a male and that most of the times both partners are violent (50% violence attributed to the female), Indian DV laws exclusively provide protection to females against Domestic violence. The Indian government must be made to answer why it has purposefully ignored these 2 very glaring aspects of domestic violence and cherry picked only the Male initiated violence aspect of the whole data. The Indian Government must wake up from its slumber and instead of believing on fund chasing feminists quoting false statistics, it must open its eyes to the peer reviews which projects the true picture which is quite the opposite of what the militant feminist's ideologues say.

Delhi HC deliberately handicaps Husband's right to defend himself

Impeach Delhi HC Judge for denying of fundamental rights in Bail condition.

In a shocking example of violation and denial of basic fundamental rights and display of extreme gender bias against Indian husbands . The New Delhi High court judge in setting the bail conditions in Bail application number (BAIL APPLN. 2102/2009) for a case of legal terrorism ( 498A ) denied a husband who is a senior scientist at CSIR the right to file any complaints against his wife and/or RTI enquiries to investigate the affairs of the complainant wife or any of her family members.

This case is a textbook example in Judicial bias that goes to demonstrate the gender bias that the Indian judiciary harbors for Indian husbands. It is for judges like these that over 56000 husbands are driven to suicide every year. Does this judge believe that he is above the constitution of India?

By not letting the husband file complaints against the wife the judge has clearly violated Article 14 and article 15 of the constitution which states

“14. Equality before law.- The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.” .

"15. Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth.- (1) The State shall not discriminate against any citizen on grounds only of religion, race, caste, sex,place of birth or any of them."

If the Indian constitution guarantees this right to all citizens of India what authority or jurisdiction does this judge have to take this right away ? By not letting the husband to file RTI act to seek information from his wife or any family members he has also deliberately handicapped the chances of the husband to seek information to defend his case and prove his innocence apart from denying the husband the rights guaranteed under the RTI act which clearly states "Subject to the provisions of this Act, all citizens shall have the right to information."

This Judge must be immediately taken off and strict action must be intitated against him for denying fundamental rights to Indian Husbands.

This comes at the same time when in a different case the same Delhi HC has backed and supported the case of a husband who used the RTI act to seek information from the Information from the income tax department to get details of earnings of his wife to prove that she did not have the income to pay the Rs 10 Lakh dowry that she claimed to have paid .

Leading US based MRA Paul Elam states that "Male studies programs are the answer to the feminist hegemony that has dominated academia and has been poisoning the education system for more than a generation." The Indian situation
With over 56000 husbands being driven to suicide annually according to the date released by the NCRB ,and millions more suffering from depression caused to apathy on all fronts , Indian men today are in dire need of serious attention . Indian men are emotionally castrated from birth and seldom receive any kind of sympathy support from the society, the government or the Judiciary. The situation of men’s rights in the US and India have many similarities although the problems in India are much more severe. Unlike the US India is also cursed with a glacial pace of justice and has a far less evolved criminal justice system. Indian laws and judges still live and breathe Manusmrithi . India too has its fair share of militant feminist organizations some having affiliations to the political parties while most are some funded by the center and operating under the guise of women’s welfare agencies. The Annual Budget for WCD ministry in India is Rs 7500 crores and the Annual Budget of the Anti Men NCW is Rs 9 crores. India too since independence has never allocated any money for men's' issues , men’s welfare or has sponsored men’s studies although India allocated Rs 1206 cores every year for Animal Welfare efforts. The government has not even taken any steps to stem the suicides of Indian husbands .The Alpha males at the center have used the feminists and the state machinery as weapons to control the Beta Males and has always considered them disposable . The Feminists on the other hands have ensured that the alpha males are happy so that their funding remains secure. This sort of symbiotic relationship between militant feminists and the alpha males has led to slow strangulation of Indian beta males from all fronts. "A Man can be made a scapegoat for every mistake a woman commits" or "Behind every unsuccessful woman there is a man" or so Indian courts still think .If one goes by the logic prevailing in the minds of the patriarchal and old judges of India a man is responsible for all the mistakes woman makes. The Delhi High court recently used the same lunatic logic a few days back when it denied bail to a man accused of having consensual sex with his fiancee apparently after he promised marraige to her.

The woman who too was equally a part in the act of this act of consensual sex with this man was not considered guilty of anything and walked away as the victim while the man is now behind bars on the charge of rape. In the same way in India if a girlfriend would have had sex with a man , under the pretext of marraige and breaks the relationship / marraige and elopes can she be convicted of anything at all ? This type of judicial nonsense gives a yardstick for people to understand exactly how Anti Male the Indian laws the Indian Government and the Indian Judiciary really is.In India even consensual sex between two willing partners is looked upon as a way for a woman to earn a reward and the man is supposed to pay the reward either by life long relationship( marraige) or direct money( prostitution) and if the man refuses to reward the woman and if the woman is unhappy for some reason the man could face the rape charge and he is then accused of having raping a woman under a pretext of a false promise when the reality is that he is actually being punished because he failed to give the reward that the woman was expecting although the sex mutual and completely consensual .It is no wonder that former Union Law Minister Ram Jethmalani, said, “Before I could go to bed with a woman, I would have to call a notary public.''

This judgment on one side is shockingly anti male and also anti women if looked at from a different angle. Does the court really believe that in 2010 Indian women have less intelligence than primates and believes that the woman was so dumb that she did not think about the consequences of her actions before her marraige ? Does the court really think that the Indian women are cows who can be forcefully impregnated anytime and the farmer(husband) must be held responsible for it always ? Why does the judiciary use the veil of gullibility and innocence to shield women when their crime or mistakes or unscrupulousness comes into the open ?

The Feminists on the other are not bothered since this is a game they are adept at . On one side they claim all women have progressed so far that they must break free of all responsibilities and stop adjusting to all situations in marraiges but in scenarios like these they prefer to project women as more gullible than even a cow just to get legal sympathy. I could well understand the agenda of the feminists because they are in the business of attracting funds , but how a High Court Judge make such a stupid judgment is completely beyond my understanding. These Anti-Male, Male Judges and Militant Mafia Feminists have made India a deadly environment for men to survive and peacefully exist.

Now going by the same logic that the so called learned judge has stated above t, should we also not release Nooriya Havelivala(The drunk female driver) and arrest the man who got Nooriya Havelivala drunk instead, because apparently Nooriya too might claim at a later date to be a gullible woman who did not know the difference between Beer and Bournvita . She is already changed her confession of drinking 13 beers by the way . Men's rights juggernaut steamrolls into the Nagpur Marathon

After a superb show of strength at the Mumbai Marathon the men's rights juggernaut today steamrolled its way into Nagpur Marathon. The turn out was fantastic with close to 300 husbands and their families including their fathers , mothers , sisters and sometimes even children demanded an end to exploitation of husbands and men in Indian courts . These families demanded immediate amendment to the biased DV act , Section 498A , Maintenance laws and child custody laws . The protest was widely appreciated and supported by the policemen , the onlookers (both men and women) who now understand the bias Indian men face in families and in courts. The sheer number of protests and the sympathetic response from the public show that the Indian society is waking up slowly to the reality that men and husbands are the victims of deliberate discrimination by the Indian government. NCW Lies once again, this time on complaints against NRI Husbands

The Anti-Men National Commission for Women(NCW) is back to what it does best. LIE!! . Recently they came up with another statement claimed that the NCW has received 331 complaints against NRI husbands. The NCW Chairperson had made a similar remark on Pravasi Bharatiya Divas 2006 when she said that over 1000 complaints had been recieved from NRI women complaining of harassment and other offences against them. However after multiple RTI applications were seeking the validity behind these claims were filed(see below) , it was proven beyond resonable soubt that that the not only the NCW but the MOIA and the WCD together combined did not have more than 50 complaints against NRI husbands with most complaints being duplicates that were forwarded between these agencies. This exposes the level of lies and deceit that Indian agencies use to defame husbands and Men in general to create and justify the creation of Anti men laws.

This is not the first time that that the NCW has openly lied .The NCW normally attracts a lot media attention by making nonsensical and wild recommendations with the sole intention of making life miserable for men. Below are some of the recent recommendations of the NCW on other issues and their brief analysis.

1) NCW went ahead and published that in 70 % of cases women are denied maintenance on grounds of adultery. SIFF activists when filed for data to support the claim made by NCW, through an application under Rights to Information Act, 2005, NCW in its reply categorically denied maintaining any such data. It was a white lie published by NCW and a delirious attempt by NCW to fudge statistics and present an otherwise picture to realize vendetta best known to it. Such a body severely lacking integrity and accountability does not deserve such a position.

2) NCW Chairperson claimed in the media that 498A is abused by women due to ignorance.

3) NCW wants the death os any married woman anytime through out her marriage must be treated as a dowry death .This was done with the clear intention to increase the dowry death numbers so that that can be used as a fudged statistic.

4) NCW recommended the removal of adultery by wife as a clause for divorce. In India women as it is cannot be convicted for adultery. According to NCW recommendations men must not be able to get a divorce even if their wives leave them and maintain sexual relations with other men.

5) NCW recommended that giving Dowry must not be considered as a crime .Taking Dowry taking will remain a crime for men however, giving dowry will not be considered a crime for women and their families.

The National Commission for Women which had transformed into National Commission for Wives has today transformed itself into the National Commission against Men in the background. NCW, originally designed to be an astute body working for the genuine causes of women has today miserably failed in its duties to protect the rights of women and safeguard the same as the arrest data published by the National Crime Records Bureau shows that more than 1, 23,000 women have been arrested in the last four years for complaints under Section 498A of the Indian Penal Code.The organization has completely lost credibility in all aspects and today relies on fudged numbers to promote its cause of family destruction. The organization has today been reduced to just a haven for radical feminists who propose virtually anything that will lead to further destruction of the Indian family system. Indian government openly promoting Dowry system

Dowry system has always evoked a lot of response in India but mostly in wrong directions. The very word dowry sparks sympathy for the bride and hatred for the bridegroom. Thanks to the countless efforts of fund chasing gender obsessed radical feminists and power hungry alpha males who have jointly spread so much of male hatred that today, the society has become completely numb to abuse of men and crimes by women.

The word “dowry harassment” is conveniently used by women to cover up their follies and hold some man responsible for it. Today, misuse of dowry laws is an acceptable fact. Everyone from Peon to President has talked about it. What does that mean? It simply means that the problem of dowry as presented has never existed, otherwise why would there be so many false cases? More so, it has to be borne in mind that the current implementation of dowry laws does not require any evidence to punish the accused – the mere statement of the “woman” is enough to punish and the onus of proving innocence lies on the accused.

Very recently, the Ministry of Women and Child Development has made efforts to reduce punishment for “Dowry Givers” while increase it for “Dowry Takers” as per the following news http://in.jagran.yahoo.com/news/national/general/5_1_6097820.html.

Common sense is something which is terribly missing in the Indian Government and our lawmakers. If there are no “Givers”, can there be any “Takers”? Instead of increasing the punishment for “Givers” which will actually reduce the practice of dowry as the root cause is taken care of, our great lawmakers are doing the exact opposite.

I was always doubtful of the real intentions of the Govt. of India in curbing the dowry system because the mere existence of it, albeit virtually, gets the Govt. huge funding from vested western agencies. Only an idiot will kill a goose that gives golden eggs. And with this proposal in pipeline, it is clearly evident that the Govt. does not want to eradicate the dowry system, but wants it to continue so that the journey itself is more intriguing than the destination.

Dowry Giving has been clearly defined as a crime in Section 3, Dowry Prohibition Act, 1961. Yet, till date not a single woman or her parents, shouting at the top of their lungs that they have given huge dowry to the man, have ever been punished for the offence while millions of men have been executed for the same. This in itself shows the anti-male bias of the Government. And now with this proposed amendment, the Govt. is simply allowing the crime legally.

Even, if the current Dowry Prohibition Act, 1961 is implemented in its entirety, dowry givers are punished severely and extravagant marriages are brought under its ambit, banning them strictly, the so-called dowry problem will be solved in the next 2 years. But it also means that the foreign funding received for “eliminating dowry” will stop. Not only that, the 50,000 crore market that runs now in the name of “big-fat weddings” will come to an abrupt end. This will be an economic Tsunami for business houses and Corporates and in turn will not only affect Govt.’s funding but also the vote bank. So, quintessentially the existence of the dowry system runs the Govt. No wonder it is promoting it by sinister law amendments.

Girls have always married up in our society, i.e. the economic status/social status/educational status of the boy is higher than the girl in 99% of the cases, barring a few exceptions (the existence of which is the law of Nature). So every girl (and her parents) looks for an educated, well settled boy for an alliance. However, as the Indian Govt. has not furthered any scheme to educate boys, most boys are not able to perform academically and the supply of “eligible bachelors” is very less. That means there is stiff competition among girls to get that “eligible bachelor” and whosoever, pays the highest amount of dowry gets the alliance. It’s simple Demand-Supply dynamics which is currently one-sided. Make it two-sided and the problem is solved. But is anyone actually interested in solving problems?

This system also works well for the Govt. as it gets another chance to project women as victims and men as aggressors and justify anti-male laws or any sinister amendment to it as well. The coy deployed by the Govt. to run its shop under the barb and paradoxical veil of “eradicating dowry” is slowly coming to surface.

In fact, the best way to eradicate dowry system is to break all marriages involving even a whisper of “dowry”, but by giving extra concessions to dowry givers, the Indian Govt. is promoting the dowry system rather than working to eradicate it.

Pampered women claim bias if they face punishment for misusing law

Now that the Ruchika case has galvanized the nation Bangalore based fund and publicity chasing feminists have now decided to get some limelight from the Pratibha Rape case which has been dragging in a "Fast Track" court for 4 years.

Women's organizations have suddenly realized that the Prathibha case may be the next big thing and have started to latch on to get their name in the press. I start by asking what Vimochana has done for Pratibha's family for the last 4 years. What has it done for the scores of mothers and sisters arrested falsely under section 498A ? In the press interview instead of pointing out the judicial delay and the need to reform the judicial and poi lice system which is dragging the Pratibha case ,Dona Fernandes makes an outrageous claim that “the whole legal system is biased against women” just because “According to this(Sexual harassment) Bill, women will be punished if their complaint is found to be faulty” . This shocking allegation exposes the level of government pamperment that the women of India have gotten used to lately .They now have started to demand laws which of course have to biased against men but will have no provision of punishment even if the woman is deliberately misusing the law to harass the other party . They do not expect to be punished for making false claims but expect to be compensated for the same. The women wishes to remain the victim even when she is misusing the laws. The dowry law sees about 98% misuse and the Domestic violence act sees about 80% misuse according to statistics released by the government and judiciary itself. Judges , home ministry and other government officials speak about this statistics in hushed tones afraid of the reign of terror unleashed by feminists in India . Any effort to reform and make laws gender neutral are met with severe defamation and we saw this with Justice Malimath’s recommendations on making 498A bailable which was met with severe criticism and protests from feminist organizations .

I do not blame Donna’s raised expectations one bit since they are not unfounded given the fact that recently drafted laws for women empowerment are blatantly unconstitutional. Article 14 of the Constitution provides for Right to Equality before law for all citizens of India. In the newly created Domestic Violence Act, firstly men are not provided any protection whatsoever against domestic abuse from their wives and in-laws and secondly the complainant woman’s sole testimony is considered as evidence of violation of protection order enough to convict the man. Both these practices do not place men and women at equal footing before the law as men face severe legal discrimination their constitutional right under Article 14 of the Indian constitution is challenged. There are scores of PIL’s pending in various different High courts of the nation challenging the constitutionality of the DV act . The government is playing the usual card of delaying the cases as much as possible trying to save face as long as possible.

How many cases of Domestic Voilence being registered by men ? None . They are not registered simply because there is not even a provision to register them anywhere . There are no laws , no NGO’s , No budget , not even a desire to take a step to protect men even they the husband suicide data for the last 13 years points that Indian husbands are in dire need to government help and protection.

Indian marriage industry is today worth Rs 60o,000 crore(yes thats six lakh cores ) .With such a huge industry at stake and with the government , industrialists and the feminist all benefiting from it in various ways , no one wants to expose the dark side of marriage to the husbands. No one wants to expose the brutal reality that the suicide rates of Indian husbands today is 100% higher than wives. The suicide rates of men and women before marriage and after divorce is the more or less the same .Have no doubt tin your mind that in India husbands are the harassed sex in a marriage . With absolutely no support from the courts and the Indian Judicial system husbands are today left with only one option ,to seek justice from god ( and hence the suicide rate ) . With a divorce rate closing 40% in all the metros, it is high time even men start protecting their assets and resort to cold , rational and intelligent planning for the future. The husbands who are prepared better always either enjoy a happy marriage ( if it goes well ) or are at least safeguarded against major losses if it goes badly. Many might feel differently about why they should bring bad thoughts or negative thoughts before the marriage. Believe me , men are the mercy of the marital laws the moment they sign on the dotted line of a marriage certificate . Walking around the fire in colorful clothes is more of a fancy dress than anything more for women. Steps to take before Marriage

Stop believing that women are the weaker sex :- The facade of weakness is the strength of a woman and the facade of strength is the weakness of a man . Do not believe one bit that the woman is doing a favor by getting married to you. Do not marry to "rescue" a distressed woman, they are the ones the bite the most . Never marry on haste . Your girlfriend of 10 years may file 10 cases against you within 10 months of marriage.

Do not attract a female match by flaunting your wealth/capability :-If you show blood you will attract only the wolf packs . If you flaunt your wealth to attract women for marriage the ones that will be attracted will be attached to your wealth and will marry to extort money and nothing more . There are innumerable state supported extortion tools ( also called Marital laws )available to Indian women and these days women are adept at using them to extract money from grooms . Their parents who are from an earlier generation too wholeheartedly support this . After all who who does not like tax free income . You are much better off stating that you are a decent young man living in a middle class with loans and responsibilities on you and no assets whatsoever. Every woman wants to marry a man only with credits but a the woman who can accept your debts along with your credits is the best match as a wife. You will be lucky if you can find one like this because they are fast becoming extinct.

See a criminal lawyer and not an astrologer:- This a MUST DO !! I cannot emphasise this more . Know the Indian marital laws before you marry. A visit to a good criminal lawyer is a MUST for every young man before marriage. It is of paramount importance for every man to know and accept the risk that should your marriage go bad ( about 30% do ) there is not one single law in India to protect the husband from harassment from your wife or your in-laws. Ask specifically about the Anti Dowry law , the Domestic violence Act , The maintenance laws and the Child custody law . All laws heavily favor the wives and the Judiciary and courts will always side with the wives and seldom with the husbands even if the wife is the culprit. Do self research on the internet and visit men's rights sites like "Save Indian Family" or 498a.org to learn more .

Maintain Legal gift list:- Please make sure there is a detailed list of all presents exchanged between the marriages parties. It is better to create an legal affidavit of the same with signatures of the bride and her family members. Indian men need to know that should your marriage go bad it is very likely that the Anti Dowry law is the one that will be misused by the wife. The husband and his family might be implicated in a false dowry case even if he has not taken a single Rupee dowry , however this will take 5 to 8 years to prove . When a false dowry case filed commonly the list of gifts received by the girl’s side is often bloated into several tens of lakhs and crores and this is done to extort money from the husband’s side immediately after a case if filed .

Seek information educational and financial assets of the wife :- Just like the men disclose their salary and earnings before marriage . The boy’s side must also insist on disclosure of all educational and salary statements of the wife’s side . Make sure you have a copy of her education certificates , appointment letters and latest salary statements. If the wife has inherited any property from her father make sure that a copy of the property papers is also kept with the husband. Most wife’s voluntarily incapacitate (purposefully sit at home, or hide where they work ) themselves if the marriage goes bad and husband will need this to prove the capabilities and qualifications of the wife apart from the wealth she will inherit. More often that not the husband will be forced to pay maintenance even if the wife is fully capable to work . The husband even if sick and ill and really unable to work will be seldom shown any mercy by the court. Evaluate the brides mother :- To impress the groom and his family it is often stated in female bio-data that the wife's grand uncle was the King of Timbuktu and her great grandmother was a princess. These details are useless . What the groom must look is the power equations in the girl's immediate family . Are they in dire need for money ? If they are then it is highly probable that you would have to pitch in with money after marriage. Don't believe for a second that economically weaker families can be less unscrupulous. Carefully see and study the brides mother for the bride would more or less look and behave the same as she ages . If the brides' father is henpecked and the mother dominates the house , most likely she would expect you to be henpecked like her father and she would want to dominate the house. There have been very few cases where the women have filed false cases and harassed husbands where their mother is not alive . Bride's mother's are the primary aggressors in all matrimonial disputes and control the women no matter how far you take your wife away from her mother.

After marriage

No children for at least 2 to 3 years :- Maintain healthy marital relations but do not jump into having a child immediately . Use the initial years to just gauge the behavior of the wife and determine if the marriage will even last. Most Indian marriages that will go down hill will start going downhill within a few months itself . If things start going downhill then relatives may advise you that having a child will set right everything, believe me it does not. If things start going downhill refrain from having a child ever with your wife. A child just gives more bargaining power to the wives and her family and leaves the man emotionally and financially bankrupt. Many times the wives and her family force an early child just to tie up the husband , do not fall into that trap . having a child a few years later or never having a child is much better than having a child whom you can see only on court dates but keep paying for its upkeep till it is 18 . The child when separated from you will most certainly be poisoned against the man and will grow up hating the father . Do you really want to have such a liability in tour life ?

Do not disclose your finances: - Refrain from disclosing all the details of finances from wives for a few years . As above use this time to gauge her behavior to see if she has married you for being your lifelong wife or just for controlling your finances and making you a henpecked husband. Give her decent pocket money to spend as per your means and if you have to have a joint account for convenience then open a totally new account and put money into it as and when needed in small amounts. Remember, even if a wife withdraws your life savings from a joint account , there is nothing you can do about it legally so refrain from giving access to prime or major accounts with a lot of money. Do not disclose property or investments for a few years after marriage till the marriage has settled down.

Do not buy property or expensive automobiles : - Never make the mistake of taking the complete loan on yourself and buying a property immediately after marriage. The same also goes for automobiles.A property (land or flat) bought after marriage could become joint property and the wife will definitely seek rights to live in it even though you will payback the bank loan for it . Stay in your parents place or a rented house for the first few years. If you are dying to buy a property or automobile buy it in the name of your mother or father (husband’s) and never in your (husbands) name since anything in your name will also belong to your wife whether she loves you or hates you . If you do not trust your parents or your siblings and have no other option but to buy property in your name then make sure that the wife made a guarantor in the loan application or that the wife pays half of the loan amount and the husband pays the other half. All wives today are capable and earning hands so it is not a tall order to share the payments of the flat or the car they will stay in or use .

Marraige is after all a gamble for the husband as well as the wife . However the husband can significantly decrease your chances of losing the hand if the husband follows the simple tips above. Lastly, do all the above things but only after a few years when you are fully confident that your wife has married you for lifelong happy companionship and someone to grow old with .

1) Indian men contribute about 82% of the country's taxes. However the Indian government allocates Rs 7500 crores ( 75 Billion Rupees )for women's welfare anually but Rs 0( 0 Rupees ) for the welfare of men.

2) India has ministry for animal welfare but no ministry for the welfare of men . The annual budget for India's Animal welfare ministry is Rs 1180 crore ( Rs 1.18 Billion ). A dog on the street has more laws to protect itself than a husband has in a marraige .

3) Dowry law is enforced only one sided , that is only husband and his relatives can be charged with taking dowry . You can be charged with dowry harassment even if you have not taken dowry . It might take 10 years for you to prove you did not take dowry. Nobody has ever been punished for giving dowry in India although the law has a stricter provision against giving dowry than taking .

4) If wife married woman in husband's house the husband and his in-laws are normally held responsible under the dowry act. However if an unmarried woman commits suicide in her parents house no one is held responsible.

5) More than 56000 husband are driven to suicide annually by their wives. If the husband commits suicide wife is not considered responsible . Instead the husband is considered weak and a loser in life. The rate of suicides of Indian husbands are plotted in a chart for the past 13 years to expose the brutal truth of rise of husbands deaths.

6) The abuse of the section 498a( The infamous Anti Dowry Law) is so famous that the United States state department has a issued a warning on its website warning for American Citizens who intend to marry in India warning them of India's criminal. The site warns US citizens stating "Furthermore, since the police may arrest anyone who is accused of committing a crime (even if the allegation is frivolous in nature), the Indian criminal justice system is often used to escalate personal disagreements into criminal charges. This practice has been increasingly exploited by dissatisfied business partners, contractors, estranged spouses, or other persons with whom the U.S. citizen has a disagreement, occasionally resulting in the jailing of U.S. citizens pending resolution of their disputes."

7) According to the Supreme court of India women cannot lie in rape cases. They always tell the truth.

8) Husband is responsible for the carrying the burden ofs wife , irrespective of the fact if she is a capable individual who has voluntarily incapacitated herself to extract maintenance.

9) Indian men and husbands are not protected against domestic violence from women or harrasment of any kind.

10) The most shocking fact is that even after this sort of pamperment women still claim to be opressed sex and womens organisations demand even more laws.

Would Rathore have misused the Draconian Molestation law against Ruchika's brother ?

Had there been a draconian molestation law as has been proposed by the Indian law minister Dr Veerapa Moily , people like Rathore would have surely used it against Ruchika's brother to harass him and then send him behind bars for years just to settle scores.

Everybody who is somebody is now thinking how they can get some mileage from the Ruchika case and this applies from the union ministers to the media . 19 years after the incident the Union ministry has suddenly realized that it has failed to give justice to a girl who had died 19 years back. How about giving justice to Ruchika’s brother who is still alive? His arrest and police torture was clear example of abuse of power to arrest by the police. However the Home Ministry has quietly dropped section 41(A) of the CrPC amendment which would have prevented unlawful arrests just to safeguard lawyers bail revenues even though it was approved by the parliament , president and the law commission and supported by the chief justice .

How can misuse of power by Police and Government officials become a women’s issue ?

Men face most of the brunt of the misuse of power by the police and government day in and day out just like Ruchika's brother did and this time a woman too was victimized by a powerful government official. Had Ruchika been a man there would not have been so much furor and the media would not even have been bothered but since we are all programmed to be react more if injustice is with a woman than a man the country is today boiling with anger on Ruchika's case.
The Ruchika case is not a women’s issue but an issue faced by every Indian irrespective of gender .It is a clear case of the abuse of power to arrest by the police and the misuse of power by the upper echelons of the government. India is a country where the strong dominate the weak and nowhere is this more evident in the upper echelons of Indian Government and politics.High court Judges( Justice Dinakaran ) , Police officers( SPS Rathore ) , Governors( ND Tiwari ) and union ministers( The list is far too long) are all involved in scandals and there has not been a single union minister or Judge or Police officer who has been punished yet in the history of the country. Most of the time the abuse is against men and the country does not care . The trial goes on for years and in the end all that remains is court dates and one fine day the accused dies of old age and the case is closed .We saw the same even in the Bofors case where no one was punished and case was closed one fine day with no punishments whatsoever. The Ruchika case is no different. The girl was molested and Indian molestation laws were strong enough to nab and punish the culprit had it been implemented honestly, however the accused being a senior police officer harassed all the members of the family mercilessly and anyone who dared to support them . Had this been a next door boy who had molested the girl he would have been implicated and would have been behind bars very soon, but since this was a government official things moved differently.

The people of India never trusted its politicians, police or the pace of justice. The Ministers do nothing more than paying lip service. However the people anger has reached boiling point and very soon you might see people throwing stones at courts and judges. The law ministry knows very well that the inept government, the corrupt police and glacially slow justice system is the sole cause of the suffering of the Ruchika’s family and not the weak laws. However the Law Ministry has found a different scapegoat to nail just to pull the wool on our faces. It has now pointed out that the Molestation law of India will be made Non bailable and cognizable. What this means is that the police will not need a warrant to arrest the accessed and the bail will be granted only if the prosecution has no objection to it. By doing this government wants to turn the Ruchika issue into a women’s empowerment issue just to move the lime light from its own inadequacies. It wants to beat the old drum and show that women in India are not adequately protected and making the law stringent will solve all problems. The government however has not recommended a single step to rein in the police and stop the misuse of power to arrest by the police, nor will it take steps to make sure that senior police officers , government officials and ministers do not misuse their power , nor will it take steps to make sure that justice is delivered swiftly. The government believes that making this a women’s issues will pacify the media and the Indians for a while .

Making molestation law non-bailable will increase Misuse and corruption among police ?

We know that more draconian the laws the more they are misused. The moment the law becomes draconian the unscrupulous elements of the society( both men and women ) will start misusing the laws on the innocent citizens. Draconian laws have never been able to achieve its target of reducing crime .They are always used in innocent people with a idea of vengeance . Nowhere have we seen a better example than the infamous Anti Dowry law ( IPC 498A ) which is just what the molestation will become if it is strengthened mindlessly. IPC 498a or the anti dowry law is perhaps the most abused sections of the Indian penal code today with more than 98% of cases filed by women under that section being false. The Supreme court of India has called the misuse of the IPC 498A , “Legal Terrorism “ . The Domestic Violence law although not as draconian as IPC 498A is also misused in about 80% of cases according to judicial officers of courts. The misuse of these laws has caused more than 56000 husbands to commit suicide every year which is twice the number of wives. With this sort of track record of implementation of women’s laws , with this sort of corrupt police and slow and anti-men judiciary it is very dangerous to arm the unscrupulous elements of the society with draconian laws.

Making Molestation non-bailable and cognizable will only increase corruption in the police since now they will pick up anyone on a charge of molestation just for settling scores . It will increase bribes and misuse of power to arrest . Any person( man or women ) wanting to take vengeance on another can file a molestation case( or force a girl to file a molestation case) and put the other person behind bars for years till the case is disposed. This will also lead to increased bribery and police assisted legal extortion of money from the accused just as the case is with IPC 498A . How will the government make sure that the innocent are not cast in the dragnet and there is no misuse of the law? Till date not a single 498A or DV act misuser has been punished.

Recommendations

Instead of creating women’s laws more draconian and camouflage this issue total government disregard for the rights of the common Indian as womens issue look like a women’s issue just to hoodwink the people , the government should work on reforming the police and reining in the police , so that they are not able to torture people like Ruchika’s brother was tortured on false pretexts. Enforce section 41(A) not thinking about safeguarding lawyers bail revenues. Weed out corruption from the police. Make the Judicial system faster so that men and women can get justice faster in any case. Make the laws gender neutral so that men too can get protection from harassment and domestic violence just like the women do. Just inciting the people and blindfolding them will not work for very long Mr Moily.

Americanized Manu-Smriti in India's property system

Americanized Manu-Smriti is a legal system where Heads-- the wife wins and Tails – the husband loses. Simply put this is a system of cherry picking western marital laws and implementing them in India just for the benefit of wives. A recent article in the Telegraph attempts to cherry pick American laws and then apply them in India after removing the gender neutrality of these laws in the United States.What this means is that in India these laws can be used only by the wife against the husband and not the other way around like they can be in America.Just like Indian McDonalds stores remove the beef patties and Indianize the dishes with chicken tikka patties , Indian feminists want to import the american laws and make them one sided so that they can be used by Indian wives against Indian husbands and never the other way around.

You keep only what you earn

The article starts of by saying that “traditional” Indian women are brought up thinking that the Husbands house is her own. Why is a woman is not taught in India that whatever she earns with the sweat of her brow is only hers to keep. She has no rights on whatever ever her husband makes unless she has made a significant enough contribution to the marriage through an extended period of time. Why is a woman brought up thinking she can like only live like a parasite on the husband ? Who is responsible for planting such non sensible teachings in the minds of innocent girls. It is the parents of the child . This tactic has been has been used for generations by parents of daughters just to absolve and deny them right in their paternal property.This argument has also been used by Indian courts and Indian wives for decades when they claim maintenance from husbands in courts. This argument works for the wife , her parents and also for the feminists. The Husband in India is expected to bear the burden of the wife after marriage in every way while her parents who have given birth to the girl child can wash their hands off. In India the wife herself is not expected to taker even her own burden and law states that she has to be carried around for the rest of her life by her husband. The interesting thing to note here is that the right of the wife is limited only to the husbands property and credit but not his debit. The wife will legally have right into the money, property and credit of the husband while she has no responsibility to bear completely or even a part of his debt. These laws worked about 100 years earlier when women were uneducated and child marriages were common. ManuSmriti was followed by both the husband and wife alike. Circa 2009 when Rs 75 Billion is spent annually on women in India , females have a higher life expectancy than males on the average and the suicide rate of husband is twice that of wife’s these laws of ManuSmriti have little meaning .

With the rising divorce rates in the country and the phenomenal abuse of the Marital laws (close to 98%) how “traditional” the modern wives are is left to the imagination of the reader.

When should a wife have a right to matrimonial property ?

The wife must always be entitled to property from her father as a matter of right and from her husband depending on her status of contribution to the marriage and length of the marriage. The Feminists however have a one sided opinion. In the Article they speak about the wife’s rights in the property of the husband. How about implementing the idea that the father of the girl must give half his property to his daughter and when the daughter is married the husband will also have 50% right in the property of the husband.

However the feminists are concerned about only one sided flow of money and property, so whatever the wife has is her sole right( that her Streedhan) , what ever the husband has is also her right( that’s patnidhan) . The father of the wife of course has no legal binding to give half his property to his daughter , so he walks away a free bird while the husbands starts to bears the burden. Also when should a wife have right to a husband’s property also remains a question to be answered. The wife must prove that her contribution and efforts in the marriage has been significant enough for her to demand a share in the property of the husband .

Comparing India’s laws with the west

When feminists compare Indian laws with the west and demand the implementation of laws in western countries in India after making them one sided , that’s when creation of American Manu-Smriti starts.

The article compares the laws in Texas and other American states. However the Feminists do not state that in the state of Texas a wife can qualify for any Alimony only after she has lived with the husband for a period of 10 years. In India women qualify for alimony and maintenance after being married for just 10 days. How about importing this law in its totality and applying it to India so that women know that Alimony is not Free lunch , it has to be earned after contributing 10 years into the marriage.

What about the husband’s rights ?

More and more women are now entering the workforce and buying and investing in property and in the US property laws work both ways and if they are created in India they must be created in the same way. If the husband has paid a significant amount towards buying the property and the wife wants a share in it she must be made to buy her share in it . In the same way a wife should not be able to throw her husband out of the property that she has acquired or inherited from her father.

The article fails to achieve gender neutrality and depicts women as an object whom her biological family dumps as a burden on her without giving her any rights into their property and husband is then made to follow Manusmriti on one side by being completely responsible for taking care of the wife and also follow American laws when the marriage breaks down and giver her half of his hard earned property.

The Government of India has been on a very serious mission . The mission to control dowry . This mission has been going on since the 1960 when the government first created the Anti Dowry law . The Anti Dowry law has been very effective in harassing innocent husbands and their families and using state machinery to extort money from them in the event of a breakdown of marriage .According to the Indian feminists Indian brides become more inflammable than gasoline the moment they enter the houses of their husbands and the dowry is the main reason for this inflammable tendencies to occur abruptly after marriage. They are freuently heard ranting about how extravagant marriages must be controlled and people must pledge that no dowry is given or taken .

What have the feminist and the government done to stop extravagant marriages ? Nothing !
Has the government created a hotline where dowry exchanges can be reported ? No !
Have the Dowry prohibition act where giving dowry is also a crime being implemeted ? No !

According to this press report Rs 200,000 to 600,000 crores is being spent every year in Indian on marriages and every body is happy that its boots the economy . The article also mentions that the Indian marriage industry is worth 12% of Indian economy.Everybody wants a pie in this huge industry from jewellery industry to real estate to automobiles to Airlines . Is anyone complaining at this stage . No , Nada !! After all the Indian marriage Industry is boosting the economy ,right ?So why should the feminists or the government say anything about it ? But the story just begins here .

Cut to one year after the marriage . The wife and husband feel that the marriage is not going well and either of them feel that the marriage needs to be dissolved . Pat comes a dowry case and here comes the stridhan list and huge marriage expenses(which boosted the economy, remember) which the girl now demands the groom to pay back . Our Feminazi friends now come into the picture as they jump into the offing and start ranting about how women are being harassed for more and more dowry and the ill effects of money being spent on a marraige. TheHusband and his family are jailed , the statistics table is updated with another dowry complaint . The Government becomes worried that increasing dowry complaints indicate a deteriorating condition for women and more funds are then allocated for women empowerment. The point to note here is that India does not track any data year wise on how many dowry cases actually proved to be true , it just tracks complaints . The complaint data is also never updated after 8 years when the husband is acquitted.

So this is a win win game for everybody. The Industrialists benefit from the 600,000 crore marriage industry , the government benefits from the taxes , The wives benefit from misusing the law , The police benefits from the bribes it gets from wives and husbands , the lawyers benefit from the cases , the feminists benefit from the dowry data that is coming in which in turn justifies their need and existence in the world of women affairs . Whats so bad about it after all ?

Ruchika case :- Is Rathore the real culprit or is it the Home Ministry which allows the Indian Police and lawyers to have their way

Do we Indians really know or care what really happens during the law making process ? We simply assume that that government is bound to work for the welfare of the common man first. Unless one is stuck in a police case does one get the true taste of the Indian Criminal Justice system . How many Indians know about how the Indian home ministry( MHA) allows the police to misuse its power and weeks safeguards the interests of lawyers by suppressing and derailing amendment after amendments created to reform the police or the criminal justice system . The way the Home Ministry has derailed the CrPC amendments of 2008 is a case study and text book example on how the interests of common people were trampled by a ministry which wanted to protect the income of the lawyers and police fraternity and did not allow reform to go through. Read below to find out more.

The Ruchika case has shocked India . The case shows how police and lawyers can misuse their legal power and get away with harrassing a family for 19 years and then getting away with a sentence as little as 6 months . As always we Indians would fume for a few days and as the media loses interest in the case we would be back to where we started from . Not a single one of us will question the ministry that allows the Indian Police and lawyers to get away with such vicious behavior. Day in and out Millions of people have faced the milder version of misuse of power at the hands of the police.

The Ruchika case is just an extreme example of the misuse of power to arrest and subsequent torture by the Indian police and this is nothing new. Just to prevent the misuse of the power to arrest by the Indian police the CrPC amendments were created in 2008 by the government of India .The Criminal Procedure Amendment Bill, 2008 had the sole intention of ushering in a new era of criminal justice in the country and amendment of Section 41 of CrPC which redefines police powers of arrest was a step in the right direction to uphold basic human rights and constitutional rights of the citizens of India. The people of India wholeheartedly supported the proposed amendment for CrPC and felt that is a very good and rational move taken by the Govt. of India and approved by Her Excellency the President of India It is in the best interest of natural justice, towards protecting the common people of India from the disastrous powers of arrest with the police, which of late have been grossly misused by them. This Amendment after receiving the assent by the President has already been notified as Act 5 of 2009 in the Gazette of India.

Misuse of Power to Arrest
The third report of the National Police Commission, referring to the quality of arrest by the police in India had mentioned that "power of arrest was one of the chief sources of corruption in the police. The report suggested that by and large nearly 60% of the arrests were either unnecessary or unjustified and that such unjustified police action accounted for 43.2% of the expenditure of the prison department." We all now know how the police arrested and tortured Ruchika's brother after he was arrested multiple times without any charge and the CrPC Amendments were created to prevent just this sort of brutality to happen again with Indian citizens. However the Police and lawyers do not like the power to arrest to go away and the Home Minister ( himself and his wife being high profile lawyers ) seems to agree with the lawyers and the police.

Section 41A – The bone of contention in CrPC amendments
One of the main features of the amendments in the CrPC is the amendment is the Amendment to Sec 41 which is nothing but the codification of the landmark judgment of the Supreme court titled “Joginder Kumar Vs. State of UP” regarding the which mandated the issuance of an by the police “Issue of Notice” to an accused before arrest which if not complied by the accused may lead to a subsequent arrest. This codification has been inserted in the recent amendments as Section 41A in Act 5 of 2009 . This judgment and the section 41A clearly basically states that an arrest is an exception and that an arrest should only be made in heinous crimes and that too only after an investigation and must be justified.

The reason for the lawyer’s protests against enforcement of Section 41A
After the CrPC Amendments, 2008 was assented on 7th January, 2009 and subsequently notified as Act 5 of 2009 in the Gazette of India, a small section of lawyers started protesting against this Act. The sole reason for the lawyer community to wake up from their slumber and suddenly become socially responsible was actually to safeguard the continuity of criminal syndication between Corrupt-Police-Officials, Broker-Advocates, and also Few-Members of the
Judiciary, those are benefited from the unwarranted arrests of the innocent people, through exploitation of money from them. The primary reason of the protests of the lawyer community is that the amendments are pro innocent citizen and Anti lawyer as false arrests are the primary source of bail revenue for lawyers in India. This fact was also highlighted by The Times of India vide their article dated 08.01.2009 titled “Lawyers strike to bail themselves out” .

Since the are one of the main beneficiaries of lawyers and the police personnel are the main beneficiaries of the unjustified arrests and abuse of the power to arrest. The lawyers realizing the fact the once an accused is issued a notice by the police he/she would simply turn up at the police station and hence there would no need to acquire bails and the income from getting bails in unjustified arrest ( which comprise 60% of cases ) which was so far being enjoyed by the lawyers would eventually dry up . So essentially enforcing section 41A would wipe out 60% of the unjustified arrest and 60% of the bail revenue of lawyers.

The MHA ignores the Parliament , President ,law commission ,and Chief Justice recommendations and prefers to listen to the lawyers
The most surprising aspect of the enforcing the amendments has been the behavior of the ministry of home affairs . The MHA was tasked with the job of enforcing the amendments after it was passed by both houses of the parliament and the President of Indian herself had given her assent to the Amendments .

The MHA then in a clear act of safeguarding the interests of these nondescript lawyer associations sent the amendments again to the Law Commission for review. The Law commission after reviewing the amendments responded back replying that the Act 5 of 2009 should be implemented immediately as the Act had come into force from previous Law Commission Reports and Supreme Court Guidelines on “issue of notice”, after routing it through Parliamentary Standing Committee of Home Affairs, and detailed discussion in both the houses of Parliament.

RTIs were filed with the Law Commission and MHA regarding the status of Act 5 of 2009. And it revealed some real strange and disturbing facts about the behavior of the MHA and shows clear sympathy of the MHA with the lawyer fraternity

1) Only some small and nondescript lawyer’s associations ( Like :- The law Association Davangere) and women groups are protesting against the notified Act 5 of 2009 for fear of loosing clients in Bail matters in non required arrests due to the “Issue of Notice”. The Law Ministry in one RTI reply’s on enforcement notification has clearly replied that it was its duty, to notify the new Act in the Gazette after getting assented by the President, which it has already done and it is now upto the Ministry of Home Affairs to issue the enforcement notification. The common man and other various NGOs on the other hand, rather want the “Issue of Notice” in Section 41A in Act 5 of 2009 to be enforced immediately, as it is the common man that suffer due to the delay in enforcement of Act 5 of 2009. 2) Some lawyers are trying to camouflage their unscrupulous agenda of safeguarding bail revenue as possible increase of crime after enforcement of the Act. Ministry of Home Affairs has on the other hand has repeatedly clarified, that even after enforcement notification, (as revealed through RTI) police can still arrest an accused, if it feels so and this enforcement notification does
not take away the power of arrest from the police. However some lawyers, it seems, are actually concerned with Section 41A dealing with “Issue of Notice” to the accused, as after issuance of notice, the accused would comply with the notice and simply not get arrested, which would therefore, curtail down these lawyer’s income through Bail Cases in non required arrests as reported in Times of India.

3) RTI also revealed that this is the ONLY Act in the Indian History, which been referred to Law Commission for review, after getting notified in the gazette, but before actually being enforced even for a single day. And in this process it also humiliated both the houses of the Parliament where the “Issue of Notice” was passed and our President who assented on paving ways to show that some lawyers are capable of holding our entire democracy into ransom so that they do not loose clients in bail matters in non required arrests. Not only that, the Law Commission has suggested the word “shall” instead of “may” be replaced, so that it would “ensure that in case where arrest is not made and further if the case requires investigation of the person, there should be at least be an obligation on the Police Officer to issue a notice which of course has to be for recorded reasons so that there is no abuse. The obligation to record reasons, will also ensure that innocent people are by issuance of notice at the whim and caprice of Police Officer”.

4) This Act had come into force after pursuant to the recommendations of Law Commission, views of the Parliamentary Standing Committee of the Ministry of Home Affairs, and also the views of the Home Ministry. In fact CrPC Amendments 2006 was drafted after consultations with the State Government and a group of officers comprising Central and State Government Initiatives. It is extremely surprising that such an important Act has not being enforced till date just because of some lawyers are protesting against it for unjustified reasons .

The MHA’s actions in not enforcing an act which has been assented by both houses of the parliament, assented by the President, endorsed by the law commission for immediate implementation and which when looked from any angle will benefit the people of India are very serious and unscrupulous in nature and clearly show a bias towards the lawyer fraternity and a hence makes a mockery of the democratic law making process.

Educated women unaware of Domestic Voilence

Even after burning through Rupees 75 Billion every year on women's issues the feminist leaders want even more.In a recent recommendation the chairperson for the Center for Social Research recommended "To address the issue(of Domestic Voilence), there should be more people appointed to handle these cases at the grassroots level and more money should be allocated for implementing the law". It is worth mentioning that along with the National Commission for women the Center for Social Research is another radical feminist agency funded by the government. Although its name says "Social Reserach" their primary reasearch is ONLY on women. Probably the Indian governmen feels that men are not even part of the society and not worth researching about . The Indian government allocates Rs 7500 crores ( Rs 75 Billion ) every year on women's needs according from the data published in the union budget . 82% of India's taxes are contributed by men and after independence Indian has not allocated a Rupee for men's welfare initiatives . Women are however supported by a union ministry with a full time union minister and national commission for women and thousands of women's NGO's who will go any lengths to get a cut from the Rs 75 Billion allocated every year for women. In order to justify this enormous budget the women organizations create fudged statistics about Domestic violence and Dowry deaths. These organizations claim that hundreds of thousands of cases related to dowry which are lodged by women every year is an indication of how severe the problem is .However they do not take into account the fact that the over 98% of dowry cases and over 80% of domestic violence cases are proved to be false in the trial case and fall through. These numbers are never adjusted or taken care of in the statistics . The Indian government also does not seem to care that over 56000 husbands( twice the number of wives ) are driven to suicide every year according to data published in the national crime records bureau. The number of suicides before marraige and after divorce is the same between men and women . It is time that the Indian men woke up from their deep slumber and spoke back to the feminists and their devious intentions.
